It's a little bit confusing, but the stories make it sound like she's attempted on multiple times to get her kids in who were at least 3 years old - claiming that they were under 3. Then allegations of just marching past the gates when the kids were denied entry. She might have been a Magic Key holder.

A social media post showing a woman and her two distressed children being ejected from the Disneyland Resort by a cadre of Anaheim police and park representatives went viral this week, drawing more than 400,000 views.​
But authorities on Thursday defended the action, saying the woman was a habitual gate crasher.​
In the video, one of the woman’s young daughters whimpers and the other clasps tightly to her distraught, Mickey ears headband-wearing mother while begging strangers for help.​
A cursing woman wearing Minnie Mouse ears was marched out of Disney California Adventure in handcuffs as two crying kids clung to her and a police officer pushed her double stroller, video of the incident shows.​
Anaheim Police arrested the 26-year-old Torrance woman and Disneyland annual passholder on Tuesday, Sept. 24 at Disney California Adventure on suspicion of trespassing, according to police spokesperson Sgt. Matt Sutter.​
The woman in the video attempted to bring her children into Disney California Adventure without paying for tickets, something she has done before, according to Disneyland officials.​
A California mother who was hauled out of Disneyland in handcuffs for allegedly trying to sneak her daughters inside has threatened to sue the theme park.​
Jessenia Diaz, 26, of Torrance, was taken into custody on Tuesday and charged with suspicion of trespassing after officials at the Happiest place on Earth say she tried to bring her two daughters into the park without paying.​
Following the incident Diaz, posted on TikTok to recount the incident, replying to commenter who asked if she was pursuing legal action: 'For sure suing.'​


I remember visiting the month before our kid turned 3. I had a passport card too for our then 2 year old.

If you cant afford to pay for tickets to get your kids in to Disneyland you probably cant afford to sue.

Less likely to be pro bono if she's suing for money, but possibly on contingent basis.

But was it that she couldn't afford the tickets, or just didn't want to pay?

Years ago (like many, many, many years ago, lol), there was a show called "Who Wants To Marry A Millionaire?" A few months after the couple got married, they divorced, the wife stating something to the effect of, "He portrayed himself as a millionaire, but he was cheap about everything and refused to spend anything! He even reuses his plastic baggies!" His answer was something to the affect of, "How do you think I became a millionaire? I'm careful with my money and don't waste it."

The situation with this mom makes me think of that... wondering if she can afford it any just doesn't want to pay.
 
I saw that story on social media a day or 2 ago. The first thing I thought of was a post on here a few weeks ago. The poster said his child was going to be 7 on the next visit, he had always said she was 2 & had never paid for her. He was wondering if anyone had ever done that with a 7 YO coz he wasn’t sure it would work. He got offended when I told him to pay for his kid like everyone else does. He said other sites are more supportive. I think the thread got deleted pretty quickly.

I figured it was just a troll, but I guess there really are people who think lying & basically stealing are fine.

One of the reports was that she was a Magic Key holder. However, I don't believe there are any child discounts, so apparently she didn't want to pay for two more.

In the latest example of unruly behavior at Disneyland, a Disney Magic Key pass holder was arrested after allegedly attempting to bring her children into one of the parks without paying for tickets.​
 
I feel sorry for the kids having to witness that. But at least in the version of the story I read, security allegedly gave the woman the option to buy tickets for them or immediately leave the premises. So if true, she refused to take the two possible onsite resolutions offered, got belligerent and inappropriate and brought it on herself.
 
Yeah, lady, go ahead and sue. Disney has an excellent legal team and sounds as if your case is pretty open and shut against you as far as the actual incident(s) of gate crashing. And if you're talking about suing for 'emotional distress' then your children should be suing YOU. You had the choice to 'go quietly' but chose to make a huge scene, upsetting your daughters. YOU did that, not Disney. And if you did it with the intent that Security would let you go to avoid a scene in front of the public, more fool you! It just reinforced to others that Disney doesn't mess around with 'rule breakers'.

People like that really grind my gears. Whether she could afford the passes or not is irrelevant. She's just as guilty either way and not being able to afford it is no excuse. If you can't afford Disney, then you just don't go (or go less). I expect that if things keep going the way they are, many will be 'priced out' at some point down the line. But most of us won't take to cheating to keep going. We'll either scrimp and save for that once a year trip or we'll shed a few tears and move on.

I agree. I’d love to drive a Mercedes but I can’t afford it. So I drive a Ford. Mercedes doesn’t owe me a car. How is this any different?

I've owned and run a small business for close to 20 years now and a few times a year some customer will become extremely unreasonable, increasingly belligerent, and will then threaten to sue. I always tell my employees that if someone threatens legal action then we are done speaking with them directly (this almost always happens over the phone) and from that point forward we will only speak to their attorney.....
I have yet to receive a call from an attorney. Guess the thousands of dollars retainer to deal with a hundreds of dollar problem tends to calm down most people.
 
Sad all around. There had to be a better resolution on disneys part other than handcuffing her in front of her kids. They should have told her to pay for their tickets or leave.
 
According to various articles, Disney is aware of four previous occasions in the last several months that she entered the park without paying for her kids. Disney believes it happened many times but she wasn’t on their radar until recently when a CM suspected her kids were 6 and 7 and called security on her… but security could not locate her in the park. Seems really odd they just didn’t hold her at the gate?

Her kids are 3 and 4, not 6 and 7. So just barely above the age limit. She was offered the opportunity to pay for the kids or leave the park but choose to verbally fight with police and park security.

Sounds like the basis of her lawsuit is that people with older children get away with it all the time and she was targeted because she’s Latino. Which is crazy considering Latinos make up a huge chuck of Disneyland’s business.

Hilarious. Other people get away with shoplifting all the time too so let me try and then say I was targeted for being a rowdy fool.

Let her sue. Let her claim racial discrimination and/or 'profiling'. Alleging that 1000s of 'others' are doing something illegal so you should be able to is absolutely no excuse and one of the p-poorest defenses around, no matter who or what you are.

Chances are Disney will fob her off with a minimal settlement (with no admission of fault). Her pass will stay revoked, she'll have lifetime ban, and she'll sink into obscurity. Good. I feel sorry for her children, hopefully there will be someone else to take them.
