Whose side would you be on? UPDATE page 17 (?!?)

And interestingly, although both are about as far West as you can get in Canada, they don't refer to themselves that way. They are "from the Coast" or "from the Island".
Do you guys have what you consider a west coast? I realize I should know this, but I thought Vancouver was in Western Canada. :confused3

Yikes! I wonder if this car were to be involved in some horrific accident with multiple fatalities would the BIL been liable?

:scared: Please don't call Manitoba the West...real westerners get sensitive. :sad1: (And Manitobans won't like it too much either! ;) )

I think most Manitobans do consider themselves Western Canada. I know I do. Western provinces are Manitoba, SK, AB and BC.

He’s the Owner, so likely.
Op... hope this worked out for you ( I didn’t read the entire thread).
He gave you the vehicle At no cost and while in Ur possession u took care of the costs. To avoid costing you more money, you chose a loophole so at the time you again ..saved money ( versus having to get another/new/er vehicle that would have passed inspection)
Fast forward to the ax ( thankfully the damages are to veh. and not people) so the payout belongs to the actual owner, ur bil.
I truly hope that what little money it’s worth will not destroy “family” ...it’s not worth that imho. It’d be great if he offered you some/all but sounds like you think not.
Glad ur hubby is okay, best of luck!

Oh come on Netts, you should know by now to leave your feels at the door when you come into the CB ;)

Would love to stay and chat but have to finish this thread https://www.disboards.com/threads/h...nt’s-credit-card.3667053/page-3#post-58874385 to learn how to impersonate someone to cancel their credit card :thumbsup2
Wait, what? :confused3 So it's good to lie to a credit card company but bad to exploit an insurance loophole, or is it the other way around? I get easily confused by double-standards.

No, Canada doesn't have a west coast. If you look at a map, it just extends to the left infinitely. Kind of like space. :lmao:

(I'm not Canadian but I do know some Canadians, so I feel comfortable answering on their behalf. ;))

Everybody's west of somewhere.

Then again, everybody's east of somewhere, too. Unless you think the Earth is flat.

Not always. My son wrecked his 2006 Taurus in November. It had 160,000 miles on it. Damage was $6,000 (before $1,000 deductible) We all assumed it was totaled. He bought another car. The next day the adjuster said based on condition they would fix it! When they found out he wanted it totaled, he got market value, $2,500......so $1,500 after the $1,000 deductible.
But again, based on condition, also known as value. Not based on what it was worth to your son.

The vehicle in the OP is described as a 20 year old rust bucket that couldn't pass the safety inspection.

Exactly. An older reliable car is always worth far more to the owner than it is to the insurance company.

i have no idea why the insurance offered to repair a car when repairs were twice the actual cash value.

Everybody's a comedian. I was asking, if they have an area that they refer to as the west coast similar to the way we do. I would have thought Vancouver would have been termed the west coast, but ronandannette said it isn't.

UGH

My husband rear ended someone last night and now our car is a write off. Thankfully, he’s ok, as well as the occupants of the other car.

We live in a province with no fault insurance. Meaning, we do not have to pay the other persons deductable to fix their car, we’d only have to pay to fix ours which won’t happen because the damage far exceeds the value of the car. I’ve said before that it’s held together by rust, and that’s not an exaggeration.

My bil (who I have long standing issues with) went to my husband and followed him as he drove the car home. Then, he came in while my husband called our insurance to report the accident. The car got towed to an impound lot where it will stay until later in the week when the adjuster takes a look at it.

I asked my bil point blank- who will get the money for the car after it’s written off. He said he would EVEN THOUGH he gave us the car as a wedding gift. I was soooo mad and voices were quickly raised.

I said we should get the money because A he gave us the car and B we are the ones who paid for new brakes, a new windshield, and a new fuel pump when they were needed. We’ve also being paying the insurance all that time, too.

The car is registered to bil because it wouldn’t pass a safety inspection to have the title transferred. So, when the cheque is written it will go to him. That’s his reasoning for keeping the money, legally it’s his car.

So, who do you think should get the money? It won’t be a lot, probably $1000 or so, so not a fortune, but enough to want it lol

Sorry for the novel..I’ll add more details if asked for them.

Its legally his car, he gets the check. When the car was registered in his name, he was on the hook for liability, so he should get the money for it. If your accident had resulted in the other motorist being injured or killed, your BIL is the one who could potentially be sued because HE was the owner of the vehicle.

Yes here we refer to British Columbia as the West Coast. Maybe it's regional. :)

@kimblebee I'm on your side! Who gives a wedding gift to a couple that requires them to put out more money to use it:sad2:. Yes the check goes to him, but in the spirit that the car was given to you as a gift, a wedding gift none the he should sign it over to you.

Many gifts require you to put out more money to use it; Coffee maker, Xbox, Cigarette lighter, almost any Gift Card, etc. Gas, insurance and maintenance are just part and parcel with having a vehicle at your disposal.

The problem here is that the relationship between family members eroded, or at least didn't improve after giving the wedding. The accident created a chance for the BIL to get a do-over and at this point in time he's judged that a $1000 gift is no longer justified for family members that don't like him.

The use of the $1,000 gift saved Op $10-$15,000 over 3 years. And now they're whining over not getting $1,000 more?
