what to offer to pass ROFR?

I am looking into buying a resale at BWV. Resales are listed between $74 and $78 per point. What should I offer to be sure to pass ROFR? If they are asking for a certain amount should I offer that amount? Is it expected that I offer more?

Cynically, I would say if you offer $89 per point you can be absolutely guaranteed that it will pass ROFR. :) In reality, it will depend on three things: 1) the price per point; 2) who pays closing costs; 3) who picks up the 2004 and/or 2005 maintenance fees. $76 per point plus closing costs plus two years of maintenance fees all paid by the buyer might go through where a straight $78-80 per point might not. Whether the contract is "stripped" of current year points seems to be irrelevant from what we are seeing in the reports on ROFR.
 
We passed ROFR about 3 weeks ago on a 152 pt contract Feb UY all 2005 points available. It was priced at 78 dollars we offered 76 dollars and it was accepted. We paid closing costs and 2005 maint fees. Thanks to Jerry at TSS for all his hard work :wave: Good luck
