What paperwork does a new direct member receive?

There have been a few posts recently about what a new resale member receives (basically just a one-page letter with your membership number), but I am wondering what paperwork a new direct member receives when signing your contracts?

I am a new resale member, and I called Member Admin this morning to request a copy of the terms & conditions - I asked about that in general, as well as specifically the member agreement, public offering statement, and product understanding checklist. The CM told me she couldn’t give me any of those documents because I purchased resale. She told me to look on the FAQ section of the website.

I’m new to the timeshare world, but this seems strange to me. I could find none of this under FAQ, and under Important Membership Documents there are Access to Membership Extras and Home Resort Rules and Regulations - but nothing that actually describes the new resale restrictions. If I’m a resale member, why wouldn’t DVC give me the rules that lay out restrictions which apply to me?

I also want to make sure I’m requesting something reasonable, which is why I’m asking if direct members actually do receive these docs. Or if there’s a reason direct buyers would get them but not resale buyers?

Is there someone else at DVC I should direct my questions to?
 
Disney is bizarre with how they are treating resales folks. This EVP is... special.

Thanks! I was wondering if there were any Terms specific to DVC (and more specific to the new resale restrictions), but maybe not.

My broker said Disney would give me the docs, but then the Member Admin CM said that was the purchase agreement I signed with the broker. I assumed there would be more than that though.

Basically I have some questions about the new restrictions and I was hoping to refer to the rules/guide. Maybe I’ll just email Member Admin and see where that gets now.
 

Things of general importance that you get when purchasing from DVD:

The “Component Site Public Offering Statement” (“POS”) applicable to the particular resort you are purchasing. About 175 to 200 pages. It begins with an approximately 20-page POS Statement that provides definitions applicable to all documents and a summary of the entire POS. The POS then includes as an exhibit the Declarations, which itself then includes numerous exhibits including two key documents you have seen mentioned lately, the DVC Membership Agreement and DVC Resort Agreement applicable to the site. You can actually get most of that POS for WDW resorts – the Declarations and all its exhibits but excluding that 20-page up-front POS statement summary with definition – online through the Orange County Comptroller. Go here http://or.occompt.com/recorder/web/? Click I Accept. On next page uncheck the box to search for specific document types; a list will appear and click “Condo Related.” Then do a search for your home resort using one of the following entries (you do not need to fill in any of the sections on that page except the ones I provide here):

Also, it may be helpful to do comparisons of your POS to Riviera's which shows how much Riviera differs, particularly in how Club Members' who are resale purchasers are now retriccted and how the terms of its DVC Resort Agreement differs from prior ones, and thus you can get Riviera's declarations and exhibits on the Comptroller's site at Doc # 20190114799.

The second most important document provided is the Multi-Site Public Offering Statement, in the 80 to 90-page range, which lays out what BVTC does and how the DVC Reservation Component for 7-month reservations among resorts works for DVC resorts that are part of the DVC reservation Component. It also has some exhibits, including the BVTC Disclosure Document, the Home Resort Rules and Regulations, and an Overview which more or less summarizes the POS. I have not been able to find any complete copy of a multi-site POS online. It can be requested (in writing) through the Florida Division of Florida Condominiums, Timeshares and Mobile Homes, which approves POS’s. That agency, unfortunately, has no online access to the documents filed with it and you need to be quite specific in identifying the actual documents you want to be provided including the probable time period they were filed. Also, the agency is quite slow in providing documents, which it will provide electronically, and it charges a per-page amount, i.e., it can be costly to get a 90-page document.

Parts of that multi-site POS can be found online. The DVC member site does have the latest Home Resort Rules and Regulations; sign in, open “My DVC.” In left column click on Membership Documents, and you will get a page where you can get the Home Resort rules and also a document that spells out that those who lack 75 points purchased from Disney get no incidental benefits.

As to getting the documents from DVC, you are legally entitled to be provided such documents, but you need to send a formal letter and list what you want to be provided, i.e., just talking on the telephone to those employees who are ignorant of the rules will get you nowhere. However, be aware DVC can charge a per page fee for providing anything, so do not assume it is free. Particularly, your right to any POS related documents is covered by two statutes:

Fla. Stats §721.13(d)1, charges the managing entity, DVCMC for the DVC resorts, with:

"Maintenance of all books and records concerning the timeshare plan so that all such books and records are reasonably available for inspection by any purchaser or the authorized agent of such purchaser. For purposes of this subparagraph, the books and records of the timeshare plan shall be considered “reasonably available” if copies of the requested portions are delivered to the purchaser or the purchaser’s agent within 7 days after the date the managing entity receives a written request for the records signed by the purchaser. The managing entity may charge the purchaser a reasonable fee for copying the requested information not to exceed 25 cents per page. However, any purchaser or agent of such purchaser shall be permitted to personally inspect and examine the books and records wherever located at any reasonable time, under reasonable conditions, and under the supervision of the custodian of those records."

See also Fla. Stat. 718.110(12) (c)1 which requires the association to maintain and provide records.

The likely way to get any documents from DVC is to send a letter to the new head of the Disney Vacation Club, Terri Schultz, 1390 Celebration Blvd, Celebration, FL 34747, listing exactly what you want and stating the request is made pursuant to the statutes.

I see one of my referenced sites has been removed because we cannot cite to it on Disboards, which I did not realize before.. That related to the Product Understanding Checklist. Here is a copy of a checklist I received for one of my BWV purchases. It is par. 8 that was important in the recent dispute when DVC attempted to change the point charts to raise studios and 1BRs year round and lower 2BRs. There was no seasonal demand basis for the change and DVC claimed it could do whatever it wanted in shifting points from one room size to another. When presented with the Product Understanding Checklist, DVC's response was not denial of meaning but instead the incredible: "Disney is not bound" by the statements it made in the Product Understanding Checklist.
