What is the medical marijuana eligibility in CA?

We have medical MJ in Colorado-and its a horrible thing-the dispensaries are EVERYWHERE-i dont see how they all stay in business even if ever resident of the state was smoking the stuff-but there they are.
You can still be denied employment for a positive drug test-just as you can for obviously being drunk at an interview--i dont think that will change.
 
I wish it were legal in NY. Not for me but for some cancer patients I know who won't do it unless it's legal. I feel for them that there suffering could be lessened but the law prevents it.

It's still a violation of Federal law and Federal law trumps State law if the employer so chooses.

There's a proposition on the upcoming ballot in CA to legalize marijuana. So soon, you may not need an medical condition or a doctor at all.
I was reading an article about this just the other day, we are a border state and I live less than 10 miles from the Cali state line. As an HR person I pay attention to what is going on in Cali. The Feds have said Cali can pass all the laws they want but those laws will still be in violation of Federal law and as I said above - Fed trumps State. Employers can choose to terminate or deny employment and people can still go to jail for being under the influence or in possession of regardless of what laws they pass.
 

As a side note and an FYI - It is my understanding, that employers do not have to accept the "card" when screening current or perspective employees and that a person can be terminated or denied hiring based on a positive drug test regardless of card holders status.

I am not sure about all states but here in MI recently there was a big story about a guy who has suffered from a brain tumor for some time and he had also worked at Wal-Mart for quite a few years. When he tested positive on a drug test for marijuana, they canned him on the spot. They would not accept his medical marijuana card. I believe he has since filed suit.
 
I would love to be able to get a script due to major, long lasting, almost debilitating depression and anxiety disorders. Xanax isn't helping much, and I just know that pot would make a great replacement. Unfortunately, I am too scared to buy it illegally and I can't travel to CA. So I'm stuck. And before anyone jumps the gun, I'm not just on xanax. I'm on 2 anti-depressants and have been in therapy for years. Here is an admission I'm not sure I should share, but I will go ahead. My illness is so drug resistant, I am having shock therapy starting next month. So I'm not just someone jonesing for some chronic. I feel the medical benefits are there, and the government should legalize and regulate it.
OP-thanks for bringing this up. I have thought about it many times. Never approached my dr with it because there is still so much shame associated with it.
 
where you go up to the counter/half door and they have a three ring binder that contains all the types of marijuana they have in stock at that time.

You can flip through the book, smell the product, and look at it. It has the amount per gram listed on each bag. The staff is knowledgeable about the types they have and they can steer you towards the type that would best suit what you are looking for. You are limited in the quantity that you can buy, but I have no idea how much it is.

Add this to the list of "Things I Have Learned on the DIS"! I had no idea that there are different types! I guess I always figured that pot is pot.
 
Although a staunch opponent to recreational use of Marijuana, I do support medicinal uses. I view it as a trade off.

MI law allows an employer to term the employee even with a medical card. So I don't see what a lawsuit against Walmart would accomplish.

I am a HR Mgr with a site in MI. We do pre-hire drug screens and would not hire if someone tested positive for marijuana even with a medical card.

Honestly I would be surprised if it were allowed for panic/anxiety. Why would I be surprised? Because I've seen first hand how anxious and paranoid people can become while smoking it. Serious paranoia where they are truly frightened of what might be happening outside the house or in their own bodies.

Then again, I know very well that opposite reactions can happen with any western drug, any herb, just about anything! (never heard of it happening with homeopathy, though)

OH definitely. I remember my mom and her friends being all excited when someone could get their hands on "Maui Wowie"...expensive and rare, it seemed...

And I had a boyfriend who got what he considered to be junk and he made it available at his Halloween party for free. Got it for free from a fellow teacher who had to get rid of her crop so her adult son could make an amateur wrestling ring. No one who used it at the party much liked it, but it was free, so....

Definitely different grades, qualities, etc.

Oh I'm so glad I finally quite dating those dudes...(and for the record my mom stopped smoking everything at 35, when I was 10)

I grew up in an extremely liberal part of Oregon, so you can probably make some assumptions about what I saw during my high school and college days.
I've seen people get anxious and paranoid while under the influence of other drugs, but I can't say I've ever seen that reaction from marijuana. I'd say it's generally the opposite.

Personally, I'm in favor of total legalization, even though it's not something I use. There is no valid reason to make marijuana illegal while alcohol is legal. There is also no valid reason for someone to lose their job for using marijuana on their own time, away from work, when it is perfectly acceptable to get drunk one day and come to work the next.

I beg to differ the highlighted point. Currently there is no way to ascertain whether or not someone is under the influence of MJ. MJ can stay in ones system for days to weeks depending on usage, metabolism etc. Here in NV we are a zero tolerance state. A single nanogram of THC (I believe) and one is considered under the influence and subject to all penalties that someone with a Blood alcohol level of .09 or higher would be subject too.

To the best of my knowledge there is no known way to test actual level of current intoxication and until they figure that out I honestly do not know how any state could ever legalize MJ.

Personally, I am all for it, however, the inability to test for it is worrisome to me.

I am not...I was a teen a looong time ago lol and I think it makes alot of people very nervous ...I do agree with the other reasons though.

I would disagree with that, based on my own experience. While I have seen people feel anxious while they are on it, others feel the opposite effects. I had suffered from major anxiety and panic disorder for years. Tried different therapies, homeopathic remedies, & MANY different prescription meds. So far, the only things that will successfully stop a panic attack to decrease major anxiety episodes for me are marijuana and Ativan (prescription med). Nothing else has worked for me so effectively than these two "meds" in the past 20 years that I have suffered with this.

Yes but the Feds will still enforce the law as it stands in CA. IE if the Feds see you with it, growing it, selling it, etc etc, they will arrest and prosecute you. So it won't do much good if the Feds will still enforce it. lol
