Hi all...I have a bit of a problem that I would appreciate help with....

Back in February I contacted a woman about renting her home in Davenport for our trip in November....I sent the 200.00 deposit along with a signed rental agreement back to her to lock the dates and had emailed her back and forth for a while and she was very helpful in answering all the questions I had asked...Well back in June, I had to cancel...her home was only a 4 bdrm and we needed a bigger home...After emailing her a few times she finally sent back a reply thanking me for looking at her home and she was very sorry I had to cancel...she asked me what I preferred...a cheque of money order...I asked for a money order...well that was JUly 12 and I have yet to receive anything...I have just sent her another email requesting it again...now my question is...what can I do???? I mean is there anyone I can contact to help me out...she is obligated to give it back right...that's what it said in the rental agreement....

i know she talked to you and everything, but did she have any kind of cancellation policy? she might not be obligated to return the money to you? just a thought.
 
Yes, in the rental agreement it says that monies are %100 refunded as long as cancellation is done before 60 days of rental...I cancelled at about 140 days.....

I think I will give it a day or two and then I will call her...

I know mail in my area can be slow. It took a letter almost 3 weeks to go 12 miles away but only took 2 days to go 2 hours away. Plus you dont know what her schedule is she might not have had time o put it in the mail yet. Unexpected things do happen. (ie picked up a paper yesterday and saw a friend of my DBF had died for no apparent reason).
 
If she is non-responsive to your calls, go a different route. First, make sure you document everything - especially all of your messages etc. Type up a letter saying that it is your final attempt to contact her for the return of your deposit. Tell her she has 30 days to reply by sending your deposit back, or you will seek assistance in handling the matter legally. Send a copy of the agreement with the area highlighted that has the refund policy. Send a copy of the email in which you cancelled your reservation with the date highlighted, and most importantly....mail it CERTIFIED with signature proof. If you have to file a small claims suit (which is fairly simple & inexpensive) you will have proof you complied with the agreement and that you did in fact make several attemps to handle the matter.
