Waiting for deed/ points question

I bought 25 points(April use year) from a friend last August. Because of my ridiculously slow BIL/attorney..and an affidavit that he didn't know had to be signed..the deed is still not recorded.
There are 25 points banked from last April to this April. Because we already booked our June HH and Sept BWV trips, we won't be able to use them.
I offered them to my brother and SIL..they decided to use them by coming down to WDW in September.
Can I have my friend(original owner) transfer the points to my brothers DVC account so he can book ASAP?
 
yes, definetly I would do it as a transfer. You can e-mail MS via a link on the website with this request. Include both peoples names and addresses as well as membership numbers.

BTW, did you consider having her transfer the points to you and than reallocate the trip you currently have booked?

So I can email Member services, even though she's still the owner according to DVC(I think).
I did think about it, but thought about it AFTER I offered them to my brother. LOL
But I'm happy they are coming to WDW so it's all good. :o)

Only the owner of the points may initiate any transfer. It sounds as though the offer was never presented to DVC for ROFR- thus as far as DVC is concerned, the original owner still controls all use of the points. The status of the contract may also depend on whether maintenance fees have been paid for this year.

Disney waived the ROFR, we sent the deed in to be recorded in Dec. In March I asked my BIL to call about it..apparantly there was an affidavit that needed to be signed, he got that taken care of and sent it back to the county to be recorded. We're just waiting for that.
The previous owner has paid all maintenance fees for this year.
So even though DVC has waived the ROFR, the points are still hers until the deed is recorded, right? So she has to initiate contact with DVC to transfer?
Thank you for all your help, I know I'm being obtuse!
