Maybe she was misinformed but it seems like something they would’ve been told (although sometimes it feels like I’m the last to know things at my job 😂 so you never know). Here’s an excerpt from her email to me:

“And yes, I can still help you with adding on points at the new Disneyland Tower. It's just if you lived in California, I couldn't help you unless I had a California license. But since you live in Texas, we're all good!! :)

Can you imagine California allowing someone to solicit and transact real estate within their state (timeshare or otherwise) without getting a license?

I guess we shall see hopefully soon here if she’s completely misinformed or not! I’m by no means an expert in real estate law anywhere! Just relaying what I was told today by my guide…. Sounds like there’s potentially a lot of confusion at the DVC offices….which leads me to believe we’re not THAT close to sales beginning 🤷🏼‍♀️

But i could see accepting payment over the phone and passing any paperwork at a later date. lol
But the guide put in a time stamped written communication (email) that they could help a prospective real estate buyer add points (solicitation) for a CA property when it becomes available even though they are knowingly not licensed to solicit real estate in that state.

That type of stuff gets people fired if it comes up in an audit down the road. It could be seen as a failure to supervise if a real estate firm (Disney) does not have a system in place to properly monitor their agents outgoing written solicitations to prospective buyers.

To sell CA real estate I'm pretty sure they have to be licensed to sell CA real estate. Where the buyer lives doesn't matter.
Well, I live in California, and when I called my guide in December to add some direct BRV points, he told me he couldn't help me because he wasn't licensed in California, and had to pass me on to a guide who was licensed here. I've confirmed that with other guides as well. A guide who is not licensed in California can neither sell real estate that is located in California nor can they sell any other real estate to a California resident.

Not sure that last part is true. My guide said she could still help me with WDW properties, and has in fact sold me some direct points at BWV since I moved to California.

I was specifically told that a DVC guide who is not licensed in California cannot sell to a California resident. I was told this by my guide (Gib McCain who is one of the more senior DVC guides), as well as the guide here in California that had to help me, as well as a third guide I spoke with a couple of weeks ago at VGF, who is also studying to take the California exam. All of this is a recent development (end of 2022). Gib has only ever sold me WDW points, and could not help me this time.

Ah that makes sense, I bought my WDW direct points as a CA resident in January 2022. Good to know going forward. My original guide doesn't seem to know that.

Well now I feel bad for sharing it here. But I did not include her name. Certainly not trying to get anyone in trouble or cause more confusion here. It is very strange she said that when it sounds like she was wrong. Although I’m sure it would be seen as an innocent mistake. She had no malintent and there currently isn’t even a product for her to sell.

At any rate, like I said, if people are this confused at DVC and the guides don’t even know if they can sell points or not, it seems like we’re not that close to sales starting. 🤷🏼‍♀️

Yes, the location of the timeshare they are selling is applicable for the agents licensing. And then DVC also has to register the property for sale in each state since many or most have specific rules governing timeshares. Canadian providences too as I recall. One affects if the agent can sell the property and the other if the resident can purchase. And each state can have specific timeshare sales requirements but I'm only real familiar with my own state. What I'm wondering is if they haven't gotten the CA state approval yet although have been approved for sale in other state. One can find this info online if one really wanted to. haha
 
Will be at DL next week, is it worth to swing by the GC for a tour/info on DVC in general and maybe a freebie? Never been on tour or visited a dvc booth in Disneyland so not sure if its the same as WDW.

They don't have any model units for VGC, it's just too small. They can take you across the street to view one of the Aulani models though, if you're just looking to get a room tour. Stop by the office in the Grand Cal, it's next to the fitness center and the entrance the the VGC wing of the hotel.

It's not much to look at. It's basically an office with a model of Aulani. You'll probably get some nominal gifts like a dry bag, some pop sockets, lanyards, and such. But the conversation with the guides is always enjoyable.
 
Every day I open the Dis and this thread slides a little further down the list I'm a little sadder....

We don't even have any good VDH rumors to chew on at this point. :bored:
