Valet damaged car...

Today Our car was damaged when taken by the valet drivers and in their care at AKL (we are staying at GF). They tried to say it was the GF valet... We said no way we would have noticed ( big dent on the side and scraped side). They were
Very standoffish about the whole thing....we went back to the GF and told the manager about the situation. He was very accommodating.

My thing is now when I get home my time is interrupted by having it repaired and out of a car....at least they could have paid for our breakfast over at boma.

Any other suggestions from anyone else's experience with this kind of situation???

They should pay for a rental car while yours is in the shop.
 
Why would they pay for your breakfast at Boma? They will review the claim, possibly try to determine if they can determine times so they can check video and then file a claim through their insurance company (note Valet is a third party). The insurance company will ensure the vehicle is repaired and will provide you a vehicle while it is being repaired in most cases. It's called an accident, things happen, but that's why there is insurance, that's what it's for.
 
But whose insurance rates increase? The OP's? Disney's? The valet subcontractor's?

You should at least file an accident report with the police, file claims against all entities* (including the Animal Kingdom Lodge valet service you used) you think might possibly have some responsibility in the matter, and inform your own insurance company.

If there is a minimum dollar amount or limiting circumstances for filing police reports, file one and let the police reject it if it does not qualify.

* For convenience it is typical to file claims with the insurance companies of supposedly responsible entities but in reality and also in cases where the insurance company denies a claim you have the right to file the claim against the entity (or responsible individual) it/him/herself.
 

I Never thought about filing a police report....hmmm is it too late now? At home I sure would have.

Yes it is an accident but when the valet keeps denying they did it that's where we have a problem.

If Disney or the valet company is taking responsibility, then there's no need to report it to the OP's insurance company. If they will not pay it, then the OP should report it to their insurance company, they will pay it and then try to subrogate against Disney or the valet company.
 
What does your insurance company say? One of the reasons you pay them is for them to subrogate for you and go after the valet's insurance company.

It pretty much says "we don't have to do anything even if we total the car" (there's a reason I only use Valet if it's my only option :) )

So even if the valet said "we did it" that does not mean they have to pay!

(And the reason they don't say "we did it" is that folks lie. Bring in a damanged car, claim the valet did it....)

I would just turn it over to your insurance who will decide if it's worth chasing Disney.
 
We use valet due to my mom handicap sticker.
Another guest couldn't have done it since it is a private lot where only valet parks their cars. I asked that question.
I did call my insurance and they will be involved if the other insurance gives us problems. If I have them open the file and start a claim it will cost me $500 upfront until and if the other insurance takes responsibility. Believe me all bases were covered. This is just a PITA

Those disclaimers on the back of the cards won't stand up in court. It's no different then car washes that state they are not responsible of something gets damaged or parking garages that say they are not responsible for any damage.

If that was the case, there would be no reason to have liability insurance at these types of places.

I work for an insurance company and I agree. You can't waive someone's rights.
 
Maybe the valet didn't do it. Maybe another guest did a hit and run while your car was parked.??

When the valet takes your car it is parked in an area that only the valets can enter. They have to swipe their card to gain access. If another guest hit the car it was in transport either to or from the front of the hotel and an accident report would have likely already been filed. The car could not have been hit by another guest only a valet.
 
Well it has been a week since the damage to our car was done at AKL and NO ONE at the outsourced valet company that WDW uses will return my phone call to see about getting my car fixed. We were told to call them in 48 hours to talk to the company about the accident. NO ONE will return my phonecall. I even went as far as talking to a manager at AKL today to see if they could help. Took my name and number and that is it so far....

I am really frustrated by the runaround I am receiving. God help anyone who has an issue with the valet company.

Took my name and number and that is it so far....

I was rear-ended a few years ago. The police report was filed and it was clearly the other driver's fault. When I contacted his insurance company, they would not pay until they spoke to their customer. I waited for a week and he would not return the calls from his insurance company, so they told me they could not pay. I finally called one last time and told them the next call would be from my attorney and we would see both the insurance company and the client in court. In less than 24 hours I had the go ahead to get my car fixed. The insurance company contacted their client again and let him know that it was going to cost him more if he didn't return their calls because he would end up paying for my attorney fees and other expenses incurred, he called them back.

Can't hurt, but give one more call and let them know that your attorney will be the next to contact them.

I didn't want to put the claim in through my own insurance because there was no guarantee that they would get the money back from his insurance and then the accident claim would count against me.

Those disclaimers will hold up in court. Sorry, but "been there, got the t shirt"

Been there, done that, got the t-shirt that says they won't! Plus, I have this discussion just a few times with my attorney friends, blanket statements like the valet one, cannot be enforced.
