US Border confiscated $2 Kinder egg from CDN woman

This was on my news webpage this morning. This is kind of funny in my opinion.
**A cross-border kerfuffle over a popular chocolate treat nearly cost a Winnipeg woman a $300 fine and saddled her with a bureaucratic headache.

Lind Bird was recently stopped at the U.S. border and selected for a random search of her vehicle. She was warned she could have faced a fine after the customs official found — and seized — her $2 Kinder Surprise egg as illegal contraband.

Bird learned U.S. authorities have banned the candy because they come with a plastic toy inside that could, if eaten, choke a small child.

"It's just a chocolate egg," Bird said. "And they were making a big deal. They said 'if you were caught with this across the border you would get charged a $300 fine,'" she said.

"It's ridiculous. It's so ridiculous," she added.

In Canada, however, officials said the eggs are so difficult to get into there's little chance they could harm anyone. As such, they are legal.

The U.S. takes catching illegal Kinder candy seriously, judging by the number of them they've confiscated in the last year. Officials said they've seized more than 25,000 of the treats in 2,000 separate seizures.

"They have been determined to present … a choking hazard to young children," said Mike Milne, a spokesman for the U.S. department of customs and border protection. Milne said the U.S. Food and Drug Administration supports the Kinder Surprise ban.

As trivial as the border seizure may seem, Bird said the U.S. government has sent her a seven-page letter asking her to formally authorize the destruction of her seized Kinder egg.

"I thought it was a joke. I had to read it twice. But they are serious," she said.

The letter states if Bird wishes to contest the seizure, she'll have to pay $250 for it to be stored as the two sides wrangle over it.

:confused3 Seriously, I'm sure there are other "contraband' items that the US border control should be worried about.
 
And the most ridiculous thing is... you can buy Kinder Surprise Eggs in the States. You'll generally have to find a European specialty store to get them, but you can most definitely buy them here; I have. I guess somehow all of the stores selling them have magically managed to slip under the radar.
 
WOW my husband went to Cananda last month and brought the kids Kindereggs back. I'm sure glad he wasn't caught! You can buy the things on Amazon easily.

They are illegal in this country. If you can find them in the US, they are not legally allowed here. Many specality stores do ship them in. And while amazon sells them, I've never been able to get them shipped to my US address.

There is some law about a choking hazard and plastic mixed with food. They were banned in the 80s I believe.
 
LOL, now I feel the need to tell the Easter bunny to bring Kindereggs : ) , I want to see what the fuss is about. Just found Happy Hippo by kinder on Amazon, too cute.
 
No wonder I haven't been able to find any kinder eggs for DD lately. A little deli by us used to have them, but it's been almost 6 months since they had any. DD really likes them.
 
We have disney versions here too. Walmart sells them and they have little disney figures inside. They have the regular version plus princesses and pooh bear
 
The agent was nice that day. She wasn't fined. That agent didn't make the rule, just following it.

I uses to work with customs and they are strict. Word of advice. Don't give them a hard time. In case you don't know if they wish they can hold you and not allow you to see an attorney. The only agency that can do that. I saw them do that once to a suspected drug dealer. Couldn't prove it but they made him worry.Let him go after hours of waiting and not allowing anyone to see/speak to him.
 
My husband, upon hearing this, says the U.S. border agents must be getting fat. then he said, 'let's order some!" :)

I wouldn't give one of these to a child too young to understand not to eat plastic, and I would guess most parents wouldn't. I guess we have to make sure all the idiot parents with no common sense don't get these into their clutches. Darwin Awards are supposed to go to the actual idiot after all, not their kids. :rolleyes1
 
oops, our German exchange student had her parents send LOTS of them when she was living here. They were cute. We opened them at the dining room table, and my tiniest kids didn't get to play with the toys at all.

I had NO IDEA they were illegal here!

Protecting us from ourselves.

Not only that, but it's not just a toy inside a chocolate egg. It's a PLASTIC egg (with a toy in it) inside the chocolate egg. So, they'd have to accidentally choke on the whole egg, OR open it and injest the small pieces. :rolleyes:
 
I would happily dispose of her kinder egg... into my stomach. Those things are so tasty!

ETA- they are really not much different than getting a toy from one of those vending machine things since you have to pry the chocolate off the toy container before opening it and getting the toy.

Apparently so, here's a Consumer Reports article on the eggs with a note to contact the CPCS if you find them illegally in your area:
"Despite the ban, which is fully honored by Ferrero's U.S. arm, Surprise Eggs are widely available here, with many imported by companies specializing in foods from countries where the product is available legally. The eggs pictured above, for example, come from Poland, and were purchased for $1.59 each in a suburban New York gourmet food store. A Consumers Union staffer recently confirmed they were available in a German specialty store in the Washington, D.C. area.
I'm not sure what people expect the Customs agents to do? Debate about actual dangers aside, they clearly violate a US Federal law that's been in place since 1938. Agents normally don't have discretion as to what banned items to confiscate, and which ones they should just look the other way on.

Ironically, if this story gets a lot of "play" in the media you may see fewer stores selling them as I bet a lot of owners don't realize that they're illegal and selling them could get their stock seized and/or land them a fine.
 
IMO the gov should not be able to ban stuff like that its just stupid.
 
This is good to know AFTER my parents bought those in from England over Christmas! They were gone the first night they were here, they're so good! Good thing they put them in their checked luggage I guess!

Kinder chocolate is SO good, especially the little bars and the hungry hippos! I had no idea the Kinder eggs were illegal, no wonder I've never been able to find them over here!
 
Wow! I've brought those back over the border into the states from Mexico and Canada. They sell those at the Christmas German fest in downtown Chicago every year. That article makes no sense considering a lot of toys here are choking hazards (legos, k'nex etc.)

Not that I agree with it entirely, but I think I can see their logic. In the case of Legos, etc., the hazard is visible. My guess is that they fear that a parent may think the egg is all candy like a Cadbury egg and give it to their small child to eat unsupervised. Since the egg does contain small toys that don't meet standards for the three-and-under crowd a two year old may end up with a toy in their hands considered "too small" for their safety without the parent's realization.
