Town plow hit my car!!

My car was parked along the rear edge of the cul de sac- right next to the top of my driveway. We are the last house on the road. The plow came up the hill, into the cul de sac and started sliding on the ice and slid straight across the pretty large circle and hit my car straight on the driver's side with the huge plow. There was no snow on the ground at that point, just ice, so he was sanding not plowing. I thought that would be an okay place to park because the plows and cars come into the circle and go to the right in order to go around so nobody should have been heading straight for my car.

The policeman actually told me to park on the other side of my driveway next time and the plow guys (one was the public works manager or something like that) agreed that it would be a better spot to park. I take this to mean that it's okay for us to park on the road. We didn't get a ticket for parking there. I looked up the planning and zoning rules for our town online and it only says something about "town maintained highways" which I think is route 1 that goes through our town but is maintained by the town not the state.

Anyway, I'm going to get the police report next week and let my insurance take care of it. The damage is on the opposite side from last year's accident but I'm concerned about the frame because the plow hit it straight on the driver's side and the plow was almost as long as the car. It pushed the car at least a foot to the right until the back wheel was imbedded in the sand/gravel on the side of the road.

Guess we'll just have to wait and see what happens. Thank you everyone for the advice and input. I'll come back and let you know the outcome.
 
If you hit someone's car (parked or moving) and are at fault then your property damage insurance covers it.

Meanwhile if he files a claim with his own insurance company then his collision insurance covers it.

Just because a car is parked illegally does not mean its owner is at fault if the car is hit.

YES! Someone understands it. :) I spent 7 years as a police officer, then 7 years as an insurance investigator and the last 12 years as an insurance agent, this is kind of my specialty.

Here we are not allowed to park within 4' of any roadway from Nov 1 to April 1. The town owns 6' in from the edge of the roadways. And, the town will replace a mailbox if the plow knocks it down, but only with a wood post type. So, if you have a fancy metal or brick type, you'll only get a wood post. The OP's town does not have these bylaws.
