There has to be more to the story...

I dont know, BUT, at least on the Magic/ Wonder, if the stateroom door is open and someone opens the verandah door, istateroom door slams very hard. Yes, i would say hard enough to sever a thumb, finger. It always made me nervous enough to constantly warn my kids to be careful. I think there are stickers warning about tye air pressure on the verandah doors, but it has been while so I cant be sure.

If you have the verandah door open and then open the stateroom door, yes, you could probably sever a finger. However, the signs on the verandah door say to keep closed. So I don't see where the guy has a lawsuit in terms of negligence on Disney's part.

The story doesn't include the verandah detail so in my mind it was the door closing and i just don't see that kind of force. More plausible if we know the 'details'. We need Paul Harvey for "the rest of the story".

True. I have a hard time believing a regular door closing could sever a thumb, without the verandah factor I mentioned.
 
The oddest part of the story to me is that he continued on the cruise. If someone in our family severed a thumb (heck, severed anything!!) we would be off at the next port and flying to the nearest surgical hospital. The whole story is just very, very strange. I feel for the poor guy, don't get me wrong, it's just all so strange.

He would probably have had to have been taken off the ship via medivac ASAP to save the thumb. I'm going to guess the cost was discussed or he was afraid of the prospect of riding in a basket to the helicopter and he said he'd wait, not realizing that many of these ports don't have a vascular hand surgeon at the ready and that his thumb couldn't wait.
 
The article doesn't specify but if his thumb was on the side of the jamb where the hinges are, it would be easy to lop off a finger.
 
I often go up to the drink station while the DW is on the balcony with the verandah door open some. Wham!!!!! comes to mind when I move my foot from propping the stateroom door open as I enter the room with both of my hands full of drinks. That slamming door is no joke! I am just used to it now. I wouldn't want to have a small child following me into the room when I move my foot.

This is my hang up too! Who on earth would cruise for several days with a missing body part? Even if he didn't want to pay for medevac, I can't imagine DCL saying ok, just go about your business and we'll put a band aid on your hand where your thumb is supposed to be.
 
"On or about April 26th"?! I'm not the most detail-oriented person, but I would remember the day I lost a thumb.

All lawsuits are worded like this. A lawyer doesn't want to have to prove that it occurred on April 26, as that isn't the important issue. If it were a car accident it would say "at or near the intersection of" - so that they don't have to prove that it exactly happened in the middle of the intersection ....
 
IF someone has their thumb (or any other digit for that matter) severed or nearly so, they are going to be in considerable pain. So the part about staying on the cruise after the accident either has to be wrong or he was loaded up on narcotic pain meds the entire time. Would one even remember a cruise in that state?? And I can't see DCL's docs giving someone in this scenario strong pain meds to "keep going" on their cruise. I agree there is way more to this story....
 
by the way, DCL does not want passengers to leave the Verandah door open because of the air conditioning system. I wander if the person sewing will state that they had the verandah door open for air or to hear the waves. That could be an out for DCL.
 
Wow! What a story! I wonder if Mr. Castro is on disboards? Mr. Castro, I'm sorry about your thumb. Otherwise, how was your cruise?
 
Here's a funny...I looked up the case...the guys name is not Marco Fidel Castro...It's Marco Fidel Acosta...this made me laugh. "Fidel Castro"...i thought that was too convenient.
