When Disney bought Marvel, they also bought the long-term contracts Marvel had with Universal. So Universal gets to keep using any Marvel characters they are already using (and I believe they have exclusive use), but they now have to make the licensing payments to Disney. The difficulty for Disney of a Marvel Universe park is that they would have to (at least as I understand Universal's existing deal) build it without using any of the characters currently in use at Universal, which is pretty difficult - no Spiderman, Dr. Doom, no Hulk, no Fantastic Four, etc. - the pickin's start gettin' pretty slim in a hurry.
But those contracts do expire as well - and Disney's been known to wait out contracts before - part of why we're just now really starting to see more and more of the Muppets in the Disney universe. Ultimately, Disney will utilize the Marvel library, all of it, but as AJ has said, whatever they do right now, will be without the big name characters.
