And who gets the blame when a pedestrian is run down in a parking lot? Do the police accept excuses like inertia (my car was moving too fast for me to stop it), being red-headed (the moron was just staring at the lights, officer, so I hit him), or having two teens to deal with?

And, you can bet I'll be sure to never wear my antlered Santa hat if you're in the world!!!

A driver is not held accountable for hitting a pedestrian as long as they are going the speed limit and the pedestrian darts in front of the car leaving the driver with no time to stop.

So, yeah, as long as you are going the speed limit, police officers do accept the excuse that you were moving too fast to stop.

Trains don't get blamed for hitting a car who tried to "beat" the train.

If you're in a parking lot and you run out in front of a car, it's your fault, not the driver's.

If you dart in front of a person pushing a stroller, it's your fault, not the stroller pusher's.

I think with your park admission everyone needs a special hat with blinkers. No matter how careful I am with steering my rather large brood through the parks, I know there has to be a time when I piss someone off. Sometimes I feel like I'm trying to merge into Washington DC traffic and we have to go up an exit to get off and back track. Disney is crazy busy and if you are trying to get somewhere quick(a show time, or bathroom). It happens. Being quick to apologize is everything. But I'm married to someone who lives in his own little world. So I know that some people honestly just DON'T see what's going on around them and can't even remember to pay attention.

Every trip I'm always harping on him to pay more attention so we don't end up being complained about on these boards.

99 percent of the time it's accidental when someone bumps into someone else, or cuts them off. We should all just be thankful we are there and realize you don't know why that person is zooming through the park not paying attention. Maybe their little one has to potty immediately, or maybe their 6 year old already went potty in their pants, of the not pee variety. (you name it, we've been there)

We all need to be gracious to everyone else. Because at one time or another we've been the one getting in someone else's way, even if we didn't mean it or even know we were doing it.

Personally I do feel that "its just an accident" doesn't cut it if anything requiring more then a band-aid occurs. If your being careful with a wheelchair or stroller you will never hit someone hard enough to cause real injury anyway but people shouldn't be able to injure someone and have no consequences because it was an accident. They should have to lose something for their recklessness. Although its no where near equal to what the person they hit has to deal with money for the injury does not seem too much to me.

And this is from someone that has had to push a wheel chair though disney.

hmm you seem to have a point.. when you are on the road and you come to an abrupt stop even for no apparent reason, then get hit from behind, who gets the ticket.. the one who hit you.. not the one who got hit... It is called tailgating, or following too closely and not being able to stop fast enough.. that is the law here in Florida.. and I do believe the World is in Florida...

So intent is meaningless? Wow, I'm guessing you aren't in law enforcement, the legal profession, insurance, education, or any other job that requires seeing nuance in human behavior.

I have more people cross in front of me than anything else and that is wherever I go Disney or Sea World or Busch Gardens or any of the several large zoological parks we have been to. I have so far always been able to stop if someone stops in front of me, and with the exception of the post parade traffic jam, I try to have enough space around us, but when someone darts across my path from one side or the other, the result has been different. Never had a chance to apologize if I wanted to as the person usually kept going without even looking back.

I have had my daughter jerk the stroller forward and hit someone while I was trying to hold it still during the post parade traffic jam. I had her in between me and the stroller because she kept getting hit by people trying to squeeze through. Child just didn't know what to do with her arms after a while cuz she was getting nervous from the beating she took. I had to have her turn towards me and wrap her arms around my waist until we could move.

Once I stopped when people started darting across my path and before I knew it I’d been standing still over 2 minutes as people kept coming. Eventually I got tired of standing there and did move forward rather quickly, just to get by the spot. I was beginning to think there was some sign I didn’t see that said “Turn here RIGHT NOW!”

When we were in MK in October, a man darted across from my left and tripped over ds. I had seen him. He turned one way, then turned my way on a dime. My dd was like, “Mom, you almost tripped that man.” My response to her was, “Honey, I’m walking in a straight line.” I don’t even think he saw us when he turned and he barely looked down at my son as he kept on walking.

I'll add the thought that people are distracted and overwhelmed while at WDW (and isn't that the reason we all love it so?) and will do things that are totally unpredictable.

Pushing a stroller, rolling a wheelchair, or driving an ECV at WDW should involve the same principle I used to observe while riding a motorcycle -- pretend that I'm totally invisible, and expect everyone around me to do the worst possible thing at the worst possible time.

But then you're putting 100% of the onus on the stroller pusher. That is to say, you're allowing non-stroller people to move non-linearly and expecting the stroller person to be the one who has to manuever.

If I'm walking along and something catches my eye and I suddenly change direction and decide to move to the right -- even if I do so at a normal pace without "darting" -- I don't know that it's the stroller pusher's fault if they run into me. Because in that case, I totally stepped in front of a stroller. And even if the stroller pusher was paying attention, them suddenly stopping on a dime to avoid hitting the sudden turner (me) then causes the people behind them to run into them or have to swerve and avoid, thereby causing a bit of a chain reaction. And in that case, it's really the walker who caused the problem.

I'm not saying that there aren't reckless stroller jockeys out there. But if the stroller people need to be aware of their surroundings, so too do the non-stroller people. Not having a stroller doesn't mean that I can just weave in and out of a crowd without watching where I'm going. Stroller people need to practice defensive driving. The people without strollers need to not try to "beat the stroller" in a crowd.

To the OP I can understand your frustration with what happenned, and it doesn't just happen at Disney, it happens anywhere there are large crowds of people. I'm originally from NYC and during the holiday season it is literally impossible to go one block without getting rammed, hit or knocked over by people, strollers or wheelchairs in the tourist sections while dodging the taxi drivers too Hopefully your family were okay afterwards and were still able to enjoy the rest of their trip.

I've been on both ends at Disney, pushing a stroller and getting hit by them. The one incidence I always remember was when I was trying to rush to the Biergarten and a family of five were walking in a straight line side by side right in front of me. My son is diabetic and at the time he was 5 years old, I knew his sugar was extremely low because he was walking one minute and the next he just dropped to the ground and said "Mommy my legs don't work."
So I picked him up and tried to get to the restaurant which was about 2 minutes away to see if I could get a cup of juice. The family either couldn't hear me or refused to hear me when I said excuse me so I tried to dart around the mother on her left when a space opened when the people going the opposite way thinned out. I did not even touch her and she said "Oh my God!". Her husband took the rental stroller and rammed me in the back and got me below the calves really hard. When I turned around he just said "Oops I'm sorry, did I do that?". Well I got to the restaurant, and while they were getting the juice for him we were in the alcove and I was testing his sugar. The family of course comes to check in for their ADR and I saw them watching me. My son drank the juice and a couple of minutes later is his chipper self. For me it was a big scare and finally relief! My husband caught up with us at that point (with our duoglider) and my other two and saw the mark on my legs. I told him what happenned but I was embarrassed b/c I didn't want that other family to hear me, but my DH was angry and wanted to confront the man. I told him to forget it, maybe I startled the woman and the husband was defending her in his eyes. Of course God is funny and we end up sitting with this family for our dinner. The father tried to be nice to us after that and the wife apologized but very, very awkward. Something I had put out of my mind until I saw this thread.

I think everyone has their own side of the story and noone is being malicious in intent when these accidents happen. I finally let it go and allowed myself to enjoy Disney again (after all we paid A LOT to play there!).

Luckily on our next trip there will be no strollers for us to push, yay!!!
