Selling and Transferring a DVC contract to close family members

My niece and her husband bought 100 Copper Creek direct points about three years ago. They have the blue card.

I don't own any DVC contract but I'm looking at resale.

Just hypothetically questions:

- Can they sign the title over to me and I send them a check? Would I be qualified for the blue card? I'm sure we will need a title company to handle this.

- What about ROFR?

- Are there any other ways to do this?

My main point is to get the blue card, if that's possible.

You can not subvert the rules. If they are selling it to you, then it goes to ROFR and you will not retain benefits,

They may be able to do a gratuitous transfer to you, but then can’t accept money for it. They allow this for family members, but not sure if your situation would apply.

They could also add you as another owner, under gratuitous transfer, but again, no payment can be made to them for the contract.

There is no way for you to buy the contract from them and retain blue card benefits as you are a resale buyer at that point. The points would also no longer be eligible for booking at RIV or new resorts.
 
same question. But I don't need blue card as I already have a direct buy at BLT. But my sister has 40 OKW points she wants to transfer to me. I don't need to pay her but any title costs she wants me to pay. would we be able to do the gratuitous transfer? Would this mean I can't use the OKW points at any new resorts? Would this mess up me using my BLT points in the future? Its only 40 points but she doesn't want them and is happy to give them to me so I can pay dues each year. Thanks for any advice

They allow gratuitous transfers between family members. I do not know if siblings are eligible so that would be a call/email to DVC MA.

If you can do it as a gratuitous transfer, and they are the same UY, they will be part of your membership and titled with the same owners as what you currently own, then all rights will transfer.

There would be no impact to your BLT, If they are a different UY, or titled differently, nee membership but again, if it is approved for a gratuitous transfer, all benefits transfer.

We are planning to use the points to make a reservation for NY 2022 next week when our 11 mos. booking window opens. Can it be transferred while there’s reservations with the points in place? Or would we be better off transferring the points into our current DVC account to make the reservation and then do the transfer of title?

Since the contract is actually changing owners, the reservation would be canceled. If she is simply adding you to the contract and staying as an owner, then it would not be impacted...but then it would not be part of the membership you currently have,

If you want a reservation soon, I’d transfer the points and then do the deed name change.

Thanks that’s what I was thinking too. I will have the points transfered into my account I have a feb use year. She has an April use year so I know they will always be separate but it will at least be on our same log-in. She doesn’t want anything to do with the contract anymore now that my father in law has passed away, and doesn’t want her name on it due to an estranged son and having to deal with probate with him if her name is on it.

People have used www.lttransfers.com to handle the deed change for a much more reasonable fee than the title company Disney uses. It can be done on your own, but may just be easier for it to be handled through a company.
