Seller has not signed docs yet-money there already

Final closing on BCV ?? Our funds have been rec'd as well as our closing docs...closing agent confirms seller received closing pkg on May 3rd but has not yet returned their signed copies...it seems odd to me that someone would not want their money!! Has this happened to anyone else?

We are selling a contract and received our closing documents on Tuesday. We have not signed them yet. I'm having trouble coordinating a time to meet DH at the bank to have everything notarized.

Four days sounds pretty reasonable to me. I'd give them a bit longer.

We finally closed on a resale in which the seller was very slow in getting back the paperwork. We overnighted our final payment the day we received our paperwork, but it was weeks before the closing service had received the seller's papers. In fact, the closing was almost delayed because the seller was so slow. I would say that this is the exception rather than the rule, but I don't think you have to worry. Sellers very rarely back out in the last minute. They are usually selling because they have to, and not because they want to.

Thank you to all who replied...I was thinking there was a deadline especially since the funds are sitting in escrow and gone from our account!

Not only that but there are limited fed-ex locations in some areas. I discovered there was a drop off box right where I work and hung onto ours for days till I could get to their office. I still wanted to make sure a real person got it. I agree about the notary thing too, that's an issue.

Well, we're selling because we want to.

The hold up on our part is getting to the notary. It's a pain.

I wish we could have gotten the documents signed the same day but that wasn't an option.

I'm sure everything will be fine.

I'm just echoing other sentiments here, but....yes, the SAME thing happened to us!!! If I had known there would be such an issue with the seller getting the docs back, I would not have spent the money overnighting the docs. It's REALLY frustrasting when you are trying to make a reservation. But, hang in there!! Just make sure that your agent is in contact with them to make sure they have not changed their mind. I think our sellers problem was also getting the notary.

Same deal, the previous owner wasn't anxious to close - and then forgot to have some of the documents notarized, so they needed to get sent back to her for her to resign and notarize.

Buying resale is great - but it isn't fast and its a little more stressful.

We are experiencing the same thing. We overnighted our papers the day we received them. The seller sent a note to the Title company stating they wouldn't be able to get to the bank until Friday. So, your not the only one.....It is tough to wait.

Remember that for FL deeds, they must be notarized AND 2 witnesses. This can be a difficult thing to do as many banks are no longer doing notary work. Also many businesses have put a stop to employees using company notary services for personal items.

A notary is a notary 24/7, companies can prohibit personal business during company business hours but they cannot prohibit the notary from performing their duty outside company hours.

True, but many can and do prohibit the activity on company premises. Getting together three people at one time including the notary is not an easy task at times. Fortunately our credit union will do it but I'm told many banks have stopped the service including in town where we live.

Do you know where the seller is located? The reason I ask is because when we bought resale, the seller lived out of the country and had to get the documents translated first. In that country, only the government can notorize, so that was another waiting period. In the end it got done, but I was about to bust waiting to make my first reservation. Hang in there and good luck!!!

I wish my bank would discontinue notary services - I'm the only one in a very busy branch. Alot of insurance agents have motaries in their offices too - that were I worked before I got into banking.

Again, many thanks to all for all the encouragement...I must exercize a little more patience!! The seller lives in Florida. I am a notary myself in Massachusetts so was not aware of Florida rules. I guess I just thought, if I had that money waiting for me, I'd be off and running.
