Seller has not returned paperwork

I closed on my first contract so easy! This second one is not going as swimmingly. Closing docs were received on 11/16 - we signed and returned and sent funds to title company by 11/18. Closing was supposed to happen on 12/4, but the sellers still have not returned their paperwork. Broker has sent messages to the sellers, but no answer as of yet. Any advice on how to be patient??
 
Not much you can do at this point besides having them reach out again with reminders. Anything is possible. Super busy because of the holidays? Cold feet? Dead? In a coma? Could be anything really. Be prepared to make another offer on something else. Would suck to start over again, but not sure what else can be done here.
 
They could have had to come up with money to close the deal, which adds complication. Assuming you still want the contract, I'd give it a few more days.
 
I have a closing delayed because the seller is international and the US Embassy is closed, so they can't get their documents notarized. I knew ahead of time, so I haven't sent the funds yet.
 

I'm dealing with this on two contracts right now. Was it a 25 point OKW contract? I know there are others out there from the four listed for sale the same day/same seller.
 
It could have to do with having to get documents notorized. In our area, we have to make an appointment at our bank to meet with a notary, so it can take awhile to find a time when you and the bank are both available during working hours to get this done.

I would start looking at other contracts and also inform the broker you are thinking about cancelling the contract because of no response or status update.
 
My seller has had excuse after excuse and the broker even sent (censored) emails of their interactions...there is a problem obviously but he hasn't told them what it is. We were forgiving for weeks.

I think he has to bring money to the table as his excuses are he didn't get the email, has had "issues", he'll get it done tomorrow etc. Lame excuses. Sink or swim tomorrow for my seller. We're just adding on so no hurry. Sorry for any buyer having to deal with this!

The broker has no answer from the seller. I have been in touch with Title company and broker.
 
Bummer! Read your contract to see what remedies you have. My seller has gone way past his 5 day "leeway" as I call it. You deserve an answer. I'm sorry!

Edit: We gave our seller until tomorrow noon to show proof he's shipped notarized docs. He'll either do it or not. If he doesn't, he likely wasn't going to...

My first contract closed beautifully, and was international sellers. This is a domestic seller, so not sure what is happening. Just hoping there will be a response from the seller soon.

I would let them know you are thinking about cancelling the agreement and since the closing date is past you would expect to get all your money back.

I would also absolutely be looking at other agreements. I would likely even start offering and if one is accepted cancel the first agreement. I may inform the Broker as well that you are going to start looking again in the meantime since you have heard of sellers not getting back for months and you don't want to miss out on other deals waiting on someone who is not responding.

I agree totally! When I mentioned I was thinking about canceling the brokers and closing agents doubled down...still nothing. That's when I knew it wasn't happening. I'm sorry the brokers likely won't get their commission either way but I am not responsible for another's actions. Sending an email threatening to cancel "might" get action. It has to be financial. Why else would a seller just not respond?
 
If I buy resale again I am definitely telling the title company that I’ll send my payment after the seller sends in their papers. I’ve heard too many stories like this lately! Last time we bought resale the seller took almost 2 weeks to send in their papers while we wired our funds the day after getting closing docs. That’s way too much money to be tied up like that!
 
Similar here - it's been a week since we signed our part of the closing docs. So... it's not too crazy of an about of time yet (but of course I was hoping for faster since every piece of the process so far has had a small to larger wait than it should). Turns out the sellers are out of the country on business. So yes - lots of reasons for a delay - sorry for those waiting because of a seller just stalling - especially due to money. Even if they have to borrow it temporarily... they'll get a big pay day soon enough!
 
What's up with these sellers? When I bought my home, the agent/broker's commissions and various fees came out of my payment to seller, so seller didn't have to pay out of pocket. The last 2 DVC contracts I read had similar wording. Either way if they renege they'll be on the hook for the commission to the broker.

Right now, I think lots of reasons. If they have a mortgage on it, they may not have the funds they need and are securing it?

The notary thing is a big deal right now in many areas given the increase in cases.

But, the ignoring or not answering is not okay unless there is something more serious is going on health wise.

Frustrating for all.
 
My broker is sending a full refund tomorrow unless by some "miracle" the notarized docs show up. This seller is in a big mess as he still has two other contracts U/A he isn't closing on either. As of tomorrow, he owes the broker the commission for the two contracts he didn't sign for us. I wonder if he finally closes a contract, if the broker can take the commission he owes for these two contracts out of one of the others. I still haven't been told what the issue is. He's going backwards - quickly.

Edit: Just got another note from broker. They have heard NOTHING from seller. Will send $$ back and give us first dibs if he "ever" sends them back.
