Ok, please dont flame me! But I MIGHT know where the school was coming from with the hesitiation to outline a specific action. MAYBE.
I have my teaching degree (but I dont teach), and so without digging out my old textbooks, Im gonna just say what I remember. I also took this class the semester that I had ds, so lets just say the pregnancy hormones at the time really clouded my brain, but here is what I remember. (of course this is in the states, idk about canada).
TONS of kids have classified disabilities in the schools (WAY more than I would have ever thought). I seem to remember something about if a child has a disability, that they cannot be expelled or unfairly punished for a behavior that was due to their disability.
The school may have been hesitate to say they would expell any student, knowing that if there was a student with a classified disability, who could prove that their behavior was due to their disability, they may not be able to expell them. In that case, they would have to work with the student within their IEP and try to remedy the problem in other ways.
AGAIN this is just what I remember, they never got real specific as far as what behavior can be attributed to a disability, as it can be very broad. I TOTALLY feel for the OP and support her 100% in what she is going through. I cant imagine how scary this must be, and I certainly hope they find the culprit and punish them as severely as possible. This is nothing to be taken lightly and the children involved need to know how serious this is.
