Rules reg fed ex package ruined by neighbors dog-

My mom ordered some stuff from LLbean that Fed Ex left on her doorstep. The neighbors dog took it and tore into it and ruined two of the items. Is anyone responsible??

The dog owners say she can't prove their dog did it (but of course he did...he chews up everything in my moms yard....she can't have flowers, yard decor, door mat, etc.) This is a duplex where they share a yard.
 
Are there teeth marks on the packaging and holes in the item? If so, are there any other dogs on the property?
 
Small claims court sounds about good--or you can call LL Bean and let them know that you arrived home to a destroyed box and items. Perhaps they can help you out.

I hate it when people deny responsibility with "Can't prove it". They might as well just say "nanny nanny boo boo" b/c they are creeps!

LLBean has excellent customer service and will probably replace the items.That said...... it's really unfortunate that they absorb the cost because of an irresponsible pet owner,

A few things: LL Bean is typically pretty good about making you happy, even when they aren't responsible for your concerns. Beyond that, LL Bean, and FexEx as its agent, does have a measure of responsibility until the items ordered are safely delivered into the customer's possession. There is a shared responsibility, since the customer selects the delivery mechanism, but that's typically overlooked by retailers that ship to the customer.

The dog owner is a lost cause. Sure, even if you could try to acquire a substantial amount of evidence that it was this specific dog, and no other dog, it would still be a lot of work to establish and assert financial culpability.
 
I would file a claim with FedX. Tell them what you think happened with the dog, and let them take it from there.
 
If LLBean will replace it, your mom may want to look into having it sent to someone elses house, you, a friend or another neighbor that is home more during the day to keep the dog from getting things in the future. What a pain for your mom though.
 
Geez, what a PITA dog and owner. The dog should never be left unattended like that and most certainly should not be allowed on someone elses porch. Is the dog's owner denying that the dog chews up things? If so, I might do a little video taping. Not that it would prove anything concerning the LL Bean box, but might show the owner that her dog does damage property, that is assuming she doesn't already know if and is just in denial.

I would also contact Fed Ex and LLBean and ask them what to do.

I left instructions with Fedex & UPS to put any packages in a specific location (dry & out of sight from the street). I believe you can also request that a signature be required for delivery.. that way if she isn't there to accept, a notice will be left...

Home owners insurance would cover it but the amount of the loss probably isn't worth pursuing it that way... I'm sure that LL Bean will be happy to replace it, they are really customer focused, FEDEX will probably say that it was in good condition when delivered & past that it isn't their responsibility - unless it was left in a spot that was "obviously" not safe... who'd think the neighbor dog would eat it!
 
She should contact LLBean. They'll more than likely take care of it. This happened to one of my clients at Christmas one year. She had ordered from American Girl for her DD and the neighbor's dog tore the package up and had the child's gifts all over the front yard when they came home (chewed up but still visible! Poor kid and poor mom trying to surprise her) AG took care of it.

It is a lot like when you ship a package and insure it. If they never receive your package, the USPS or UPS or Fed-Ex will reimburse you.
