ROFR thread question...

I hated to post this on the anyone made it past ROFR question since that seems to be just for watching...

Is there a time limit Disney has to decide on a contract once it is presented to them? Poor Beca and Magicalful - how long can they make you wait???

I am on pins and needles on my contract - how do stand the suspense?

I have been told that they have 30 days to decide. However, that assumes that the contract is perfect. Scratch's contract was apparently defective in some way, and instead of telling him, they just set it aside until he called wanting to know what the problem was. So the contract had to be redone, and resubmitted.

In Beca's case, she seems to believe that her agent's contracts get drug out to the last possible second. Don't know why that is, but that's what she says. Fortunately, it's not her first rodeo, so she's pretty sane.

The whole process is tedious and frustrating, although it looks much more tolerable AFTER you pass ROFR. I don't have any brilliant suggestions to improve it - it just is what it is. It reminds me a little of labor - nobody's idea of a party, but you have to go through it to get the result you want.
 
If it helps, when you look at that list, most people are through in 2-3 weeks. But I feel bad for the people waiting so long as well, I was not so patient! We heard in 2 weeks, 3 days, BTW.

I know the feeling. We were quite confident our price was right, but those were 13 of the longest days in recent memory!
 

champagne27 - Wow!! Thanks for worrying about me!!! I was REALLY sure that I had read something SOMEWHERE that you had to make your closing date at least 30 days out from the day you were writing the contract, and if you have not heard from DVC on the date you were supposed to close, you can go ahead an close. So, it's not that DVC has a "time" to respond, but DVC's lack of response cannot keep you from closing if you have given them at least 30 days.

However, I cannot seem to locate where I read that...so, if you cannot find it....then, it is not true!!! One of these days I will find it.

In my case (and, in Magicalfun's case) we are both buying from an individual with no broker involved. I didn't think there would be any "drawbacks" to not having a broker....but, it seems there just might be. There is no one who "knows" the rules watching out for us. I think part of the reason DVC is "dragging their feet" with us is because they can. If there is no "time crunch" to make a decision, why not hold onto the contract and see "where the market goes"....this contract may look like a "better bargain" in a few weeks.

However, that is not what my closing agent says....she says ALL of her contracts take 30 days. I TOTALLY expect that Magicalfun and I will hear late Thurs or early Fri (although, our closing agent says that when an agent is not involved, DVC does not always send out emails saying that you passed...sometimes, they do it by "snail mail"). So, even though we may not hear this week, I suspect we will be thru ROFR this week.

DVC ROFR is a STRANGE thing. I have a friend who submitted to ROFR on an AMAZING BCV contract (3 years' worth of points), and he got thru in THREE days...he submitted on 2/17, and was told that he passed ROFR on 2/20. Even his agent was shocked on that one!!

The reason I started that thread was because I was trying to "make sense" of the ROFR process. I thought if we "pooled" our knowledge, we might discover some things about the process. One thing I have discovered from the results posted on the thread is that the ROFR committee meets Monday and Thursday mornings. That is about about all I have learned (along with a better idea of what will pass and what will not). I have not noticed a correlation between how long it takes to pass ROFR, and the chances of you "passing" or having DVC take your contract. I also thought that DVC might "pool" contracts to examine them (look at all VWL on one day, all OKW on another, etc)...but, that doesn't seem to be the case.

I would LOVE to know why some people pass ROFR in three days, and others in 30....maybe my agent is right, and it has more to do with your closing agent, or maybe it has more to do with the "guest" who is buying. My friend is a LONG time DVC owner...so, maybe they just "passed" him quickly. It is a very interesting process...one of these days I will "figure it out"!!!

Until then....I'll just suffer through!!!

Hang in there champagne27 - it is a miserable process, but the more you "dwell" on it....the longer it takes. Remember...a watched pot never boils. I imagine you will hear in a total time of 2.5 weeks. That seems to be the "going rate". Try to relax until then!!!

My original contract was submitted January 24th! I had questioned something on the contract but was told that their site was wrong. I let it go since their site also claimed that the points were going for a total cost of $0.00!LOL

When the Contract got into Disney's hand's, they questioned the discrepency but instead of contacting the agency, they put the file aside and forgot about it! Until further prodding from my agent that is when we found out about Disney questioning the points amount. Contract had to be redone and resigned and resent to Disney on March 4th, with the promise that the file would stay on top. Obviously that promise not kept!

Contract was to have closed March 12th. I was told that since nothing had been accomplished that I could bow out! Yeah, Right! :rolleyes: I'm in my eighth (8th) week of waiting!

As Beca has so kindly said, I should get the points by default!LOL

I'm just hoping that Disney has not put my file aside collecting dust once again! Time will tell.

Good Luck Beca! And regarding that 30 day limit, can't get anyone to admit to it! Only that Disney can take up to 30 days to decide!

I'm glad to know that at least you figured out the review board meets on Monday and Thursday morning. Now at least I know what days to hope for. I am so nervous that I called our agent to see if we should raise our offer $1/per point. Since we have time before our first trip though, I decided to sit on this one and look for another one if it is refused.

Your wait is truly amazing and I sincerely hope you hear this week and it's a PASS!

I have absolutely no patience for waiting so it's nice to know that there are others out there waiting too...

Good luck finding the info on getting to close in 30 days if there is no response - wouldn't that be cool!!!
