Hi all,

This is my first visit to the forum and wanted to pass on our recent purchase info.


$92-$5,036-48-VWL-Mar-48/'15-48/16 -sent 11/18 and passed on 12/2 :)


This was our second resale purchase with the OKW contract taking 33 days to pass ROFR :(

Btw- I thought Disney only had 30 days to respond. I assumed the forfeited after 30. They can go longer? I'm at 28 days today and I can't take any more!! Lol!
 
I may be mistaken, but I'm pretty sure the actual rule is they need to receive notice at least 30 days before closing to be given their right of first refusal. Since they have that window, I would assume they try to answer all requests within the 30 day window.

No it can take a little longer than 30 days sometimes. Not often but it does happen

I was under the impression that there was a 30 day limit as well. If it went over then thee had to be some reason, incorrect paper work or something. But general slowness on disneys part wasn't an acceptable reason.

Nope . It has more to do with the closing date, than a 30 day rofr deadline.
I think Disney must make the ROFR decision 30 days before the closing date listed on the contract.

Interesting. I don't doubt it, but it certainly isn't portrayed that way to the buyers. Regardless, I went in knowing I was at the mercy of the mouse. If things took to long or otherwise didn't go my way there wasn't much I could do.

Brokers usually set the closing for approx 60 days from accepted offer / contract date.
Then it goes to ROFR, so Disney usually has approx 30 days in which they must make their decision, because they need to get it done 30 days before the projected closing date. Thats why its always stated Disney has 30 days , when in reality it can vary due to closing date.

I am sure some others can chime in with more exact knowledge about it . But Disney having 30 days or less for the ROFR decision is a misnomer .

There is just no way I would have the time to do this, and I have no doubt your time could be well spent doing other things. But I am soooo grateful that you've taken the time to do this. It it such a great resource for those in the market for DVC. And even if I do escape addonitis, I'll be interested in keeping tabs on ROFR and sales activity.

Technically and contractually, YOU have to give Disney 30 days notice of a sale prior to closing, and they have the right to step in as the buyer UNTIL YOU CLOSE. If you give them the minimum legally required amount of time and don't hear back, then you could close. So, if you actually schedule closing, you could limit Disney to 30 days.

Practically speaking, no broker or title company seems comfortable to force the issue with Disney. They will not close without hearing back one way or another. Usually, they need paperwork from Disney in order to close anyway, so it's not practical to close at 30 days. So, instead of just closing when you haven't heard back, Disney sends a legal document, the ROFR Waiver, saying that they aren't going to take the contract. After receiving that waiver, the title company will set the closing date. Since the closing date was never set, Disney has as long as they want to keep you in limbo.
 
Disney contacted our agent yesterday and informed them that the seller's of the account we have an offer on misrepresented the available points for 2015 (140 actual vs 165 advertised). Not a big deal, but frustrating that it will eat about 2-3 days of ROFR review. I guess it's good that Disney is already looking at our offer?

Are you able to negotiate a lower price since there are less points? :confused3
