Resale member benefits question

Houston, we have a problem.

We passed ROFR in March. I just looked it up on the OCC site and it doesn't have that clause - just the one about cruises and the concierge collection.

Now I just looked up my contract on OCC (good idea gluestick girl), although I had been assured by my brokers that I was grandfathered, my contract does have the additional clause....I have an email into the broker, I'll report back...

I passed ROFR on 3/7 and closed on 4/18 as well. I pulled up my deed on the OCC site and it does not have that clause. Something doesn't seem right. Have you received membership cards?
 
No cards yet. I got an email back from my broker (very quick). She said she has heard nothing new since their decision to grandfather in those who had a contract at Disney by April 4. Today is day 12 since the filing so I will be calling DVC later today in hopes we are in the system and I can get some type of confirmation. It does concern me that yours does not have that clause and mine does, hm.m..

I'll be curious as to what your broker says about the new clause. My broker said I'm still grandfathered in and Disney started adding this new clause to waivers as standard procedure. This new clause makes me a little unsure about being grandfathered in. Guess I won't know for sure until I'm allowed or denied a perk.

My contract was sent for ROFR on 3/17, passed ROFR on 4/18, and closed on 5/24. My ROFR waiver on the OCC has the new clause on it. I'm in the fun process of waiting on my welcome package and member number. For now I'm taking Disney's original statement and my brokers word that I'm grandfathered in.

It seems that those with the clause passed ROFR after 4/4. I really hope this isn't the case but I wonder if that's what they meant when the stated that "contracts" had to be received by 4/4. This whole thing has been a big mess.

I did think at the time that the statement received by Disney was conveniently vague

You can search the occ site for all waivers of ROFR. You should even be able to limit it by date. You should be able to see everybody's.
 
Ok, I have some info for us. As I am DisOCD, I called today, day 12 after I saw my deed on the OCC (as that seemed to be the average as I watched everyone comment). Unfortunately they found that my unofficial paperwork had been sent over but not my actual recorded paperwork. I contacted my broker and they are now saying Disney did have it, etc. So hopefully tomorrow I'll know more. That is a real bummer BUT the great news is, the actual Disney administrative lady (they sent me to someone higher up when they realized something was wrong) said very easily that I am grandfathered in as my received date was 3/21. That is my received at Disney office, my ROFR was approved later. She sounded higher up and like I said, she said it without hesitation. So as frustrated as I am about this paperwork issue, I am hopeful those of us with contracts at Disney before 4/4 are actually grandfathered in. Now fingers crossed they figure out the issue and get me set up tomorrow. I have a bad feeling I'll be put to the end of the 2 week que but what can I do about it, not much! I'm sure I'm already at wait status as my 11 month for BWV was 5/28.

I wonder if they are conveniently making that "mistake" on all of them and fixing them only if people call to complain?

Hi - It's funny you say that because I was just wandering around the boards laughing at how obsessed we all are, so I love that you have a conspiracy theory here : ) So what happened was, I called and said, Oh I'm just wondering if my account is set up. I've noticed people who call around day 12 seem to have some luck getting their number. The kid was super nice, he looked and then he said, hmmm (hate it when I hear that). He said let me go check on something. So then about 5 minutes later another person got on the phone. She went through the computer and said, I see that you were recorded on May 20th but we only have your unofficial recording. You have to call your broker to get the official record sent over. So I emailed with my broker. They were very responsive and said they were calling Disney as the official had been sent on the 20th. I haven't heard anything since. The Disney lady even put me on hold to look through today's mail to see if she saw mine come through. So I think it was a legit mistake just on mine. Stuff like this happens to me a lot, that is why I called today, day 12! If it went smoothly, then I would almost be more suspicious!! I still won't believe I'm a real member until I get into that DVC members lounge!!! LOL
 
I am also in the group told we are grandfathered in (submitted for ROFR 3/13 passed 4/6 recorded 5/9) but that had the new language in the deed. Now waiting to see if we will get membership cards. I wonder how to wait before calling, we requested them on 5/21.
 
Thanks for the info everyone! I guess we will really just have to wait and see what happens when people with newer contracts get to the parks. Regardless, I am very excited that we've closed and are just waiting for our welcome packet and member number. Can't wait to book our first DVC member trip!
 
So we got our welcome packet with magnets and our membership number. It also said we would be getting some other mail within 10-12 days. I called to get my online account set up and was able to book our first DVC owner trip in February/March (woo!!). On my account I'm able to download digital membership cards as well as request new cards be sent to me. Anyone know if this means I'm in the clear? I want to buy discounted APs before our next trip, but I'd hate to get down there to pick them up only to find out I'm ineligible for the discount and have to pay the difference.

Sounds like you're good! If you want to verify even further, go to the annual pass page and try to buy the GOLD pass.

It lets me get all the way to where I would put in my payment information, but I'm not ready to buy it just yet so I haven't tried to go all the way through.

I don't recall the 3 year thing being in there before. Of course we all know they can change and/or discontinue any at any time, but I always thought they were only good calendar year by calendar year.( and shorter if they choose like valet parking, etc.)

That "3 year" disclaimer is listed in copies of the Member Benefits Guide from 2007 and 2009. Probably part of the standard disclosure required by Florida law.
 
That's exactly what it is. Putting the 3 year maximum just makes it so they don't have to update the disclosure as often.

The current blue cards expire 12-31-2021. That date makes sense based on the 3-year disclosure update cycle. The current one is for 2016-2018, then the next will be 2019-2021. In 2022, there could be another major change, possibly dumping ALL resale buyers from benefits (which the current disclaimer actually allows for even though they chose to still issue cards to previous resale purchasers.)

They don't just put words in writing for no reason, they have a plan, we just don't know what it is and they won't tell us until they have to.
