Renters Agreements

I have seen several of these. I think there should be a paragraph at the end that the renter acknowledges that he/she shall be responsible for any legal fees in the event that he/she breaches this agreement.

Just a thought.
 
I think most of the agreements that have been posted here are fairly informal and intended as more of a means of communicating expectations than as a strong legal contract.

I'm not sure who you mean by the "renter"? That's a term that is often applied to both parties in the transaction. Do you mean the DVC owner? That's the only person who can really breach the contract if they've set up rational rules for down payments and payment in full in advance. If you are referring to the DVC owner, I would disagree with putting that in the agreement. If you are talking about the person who is buying the reservation, it probably doesn't make sense.

These transactions are pretty much about trust. There are things that can be done to protect both parties but as an owner I would never agree to putting that kind of language in an agreement. If someone didn't like the agreement I was using, I'd suggest parting ways and both parties try to find another match elsewhere.

I understand the concern about one party breaching the contract. But I don't believe that the agreement should start talking about who pays for legal fees.
 
You can always go after them for legal fees if you need to. I think if you put it in the contract you start sounding really unfriendly.

Besides, my parents are mad enough at me as it is for sending them one without putting THAT in there....

never rented before, interested in seeing what one of these informal agreements/contracts looks like before I agree to rent someones points, etc.

I understand how this is way different than renting hotel rooms, etc. just wanting to see what most owners feel is "fair".

also know lots depends on personal UY, availablity at resort, etc.

no problem with paying deposit ahead and paying in full 30 days out, just wondering what happens if something comes up? what are options, penalties, etc.

what about trip insurance? does that apply at all?

any advice, help cautions very much appreciated.

wanting to play by the rules but need to know them!
