Rental Contracts

Is there such thing as a standardized rental contract to protect the interests of both renter and rentee?? If so where can I get one??
 
Usually the owner of the points provides the contract, not the non-owner. However, if you get a member who does not use a contract, you could suggest one to them. They own the points, they make the decisions.
 
I have my own rental contract. if someone doesn't like it, I'll rent the points to someone else. Mine was approved by an attorney, and I wouldn't use one a renter gave me because I couldn't be sure it would hold up in court. (Plus mine specifies that any litigation be done in Florida.)

So far I haven't had anyone take issue to it.

I'll agree that contracts for a few hundred (or a few thousand) dollars are essentially unenforceable due to the time, effort, cost, and uncertainty involved in litigation. But I don't think that makes them useless.

Renting is based on mutual trust and understanding of the ground rules. To me, to the degree that contracts help build that trust and understanding, they are helpful.

This is exactly what I was thinking when I read RustyScupper's comments. A contract is mostly a very good communication device, and sets up expectations. The posts we've read about people not sending in money on time, or owners not being available for confirmation....almost all of them indicate that they didn't have a contract.

Actually, I term it an agreement (sounds less legalese) and as JimMIA points out, it's a great way to put in words the mutual trust that goes on when renting points. ::yes::
 
Agree with JimMIA and Granny. Contracts give you an opportunity to clarify and memorialize what you agreed to.

You're underestimating the value of good feelings in a financial transaction.
 
My contract offers penalties for cancellation, as well as non-payment of final monies due which are quite enforceable. Bascially the person renting my points signs that they are aware that if they don't pay the last payment by the due date, I'll cancel their reservation and they forfiet the deposit. If they decide they want to fight it, they have to do so in Florida.

By signing the contract they agree to the terms (as do I) and it covers my butt.

Also it has a force majuere clause that states that if for some unforseen reason beyond my control Disney cancels the reservations (such as part of the property being destoyed by any given peril or act of God) I will make a reasonable effort to try to reaccomodate them elsewhere, but if I'm unable to, the only thing I owe them is the return of their deposit. In other words if the place burns to the ground and I can't get them another room, I can't be held responsible for their plane tickets and such.

Like I said, mine was written by a friend who is a lawyer. We bartered his services for a plate of Tollhouse Cookies. (He's a single guy with a sweet tooth. :thumbsup2 )
