Do bees attract people trying to score bees to sell honey on the black market?
No, but they are a risk none the less. I think it is an exaggeration to think that as soon as you start growing that hordes of thieves will be swarming in to grab the plants, especially if it is legal for medical use in the area. I knew lots of people that illegally grew it in college, and not once did they have someone try to steal it.
As others have suggested, he should grow it inside or keep it hush hush. My thing is that if the law says he can have then he can have it! Granted he is renting so the OP is in her right to exclude it in a lease or just not renew his lease. If there is no provision to prevent someone living near a day care from having it then there isn't much you can do. Just like you can't pick and choose what laws you're allowed to break, you also can't pick and choose what laws others are allowed to follow.
