No, but they are a risk none the less. I think it is an exaggeration to think that as soon as you start growing that hordes of thieves will be swarming in to grab the plants, especially if it is legal for medical use in the area. I knew lots of people that illegally grew it in college, and not once did they have someone try to steal it.

That's gotta be a typo, right? His script lets him keep A POUND AND A HALF of weed on hand at all times?

What does Oregon law allow a registered patient to do?
Under the Oregon Medical Marijuana Program, registered patients can use marijuana, and grow it or arrange to have a caregiver grow it for them. A patient may store (possess) up to 24 ounces of dried plant material. Patients can give marijuana to other patients, but they cannot legally buy it or sell it to anyone.

To produce the medicine , each patient may have a maximum of 6 mature plants and 18 starts and seedlings :

Mature plants - Any plant that is 12 inches or over, in height or width, or in bloom is considered mature. Each patient can have up to six of these.

Starts and seedlings - Plants that are under 12 inches in all directions, with no buds or flowers, are not mature. A patient can have 18 of these smaller plants.

Actually, it is an entire industry right now to steal from growers... It is sort of an underground crime thing, they come in dressed as DEA officials and steal your crop. They have badges, forms, everything to look legitimate. Then you try to call to complain and find out that they were just rippers.
I wish I was joking, but it's a serious business and with all the states expanding to allow medical use it is on the rise. Being a grower is a dangerous business. So if they came to his house... and he tried to fight them... he is right by an in home daycare?!? That is putting those children in a LOT of danger.
 

People seem to forget that the "legal" portion does not include the Federal government. 999 times out of 1000 (or more) the Feds will do absolutely nothing - BUT

Never underestimate what the Feds will pull out to use against you if some other issue comes up. I know people with DEA and IRS - the stories they've told me!!!!!!!

Is it blackmail? Sure - but it happens.

Oh I believe you, and if he is out telling people he's got it, than he's an idiot! In my previous posts, I was assuming that he was not advertising it (although the plywood is probably a dead give away.) :) As others have suggested, he should grow it inside or keep it hush hush. My thing is that if the law says he can have then he can have it! Granted he is renting so the OP is in her right to exclude it in a lease or just not renew his lease. If there is no provision to prevent someone living near a day care from having it then there isn't much you can do. Just like you can't pick and choose what laws you're allowed to break, you also can't pick and choose what laws others are allowed to follow.
 
Does your written rental agreement with him allow him to plant and grow plants in your yard and also construct a fence? If he has violated the rental agreement, then it is time to take action.

I would agree that "landscaping" limits should be covered under your contract - if not I hope others can learn from your circumstances. I wouldn't want a renter to plant an entire yard full of corn, for example, in a suburban neighborhood. It would be difficult to return it to a usable yard should the tenant move. I'd focus on getting him out for that reason - I don't care what he's growing. If he needs to be able to grow - he'll find someplace else to do it.
 
Sorry...haven't read all the posts. Here in CA many homes have illegally become "pot houses." The humidity required to grow these plants indoors completely destroys homes because of the mildew, rewiring, and water buildup on the floors.

There really shouldn't be a debate here on whether or not medical marijuana should be legal, but the question should be about the condition of your home if the plants are grown indoors. I recently watched an episode of Holmes on Homes on HGTV, and he helped a woman who did not know her rental was a pot house. You couldn't imagine what her place looked like.

Legal or not, growing indoors will cause serious problems that you should consider. I'm sorry that you are going through this. :grouphug:
