As for the cookies, do you mean the gingerbread men with mouse ears? I actually think those are sold year-round! I thought that were seasonal - maybe not put out until September or so - but others have reported seeing those cookies in other months. The regular, non-mouse ears cookies may be on a different schedule. Not sure about those.
If you don't see the mouse ears cookies in the bake shops (like Blue Ribbon Bakery or something), look in all the candy shops. Those cookies are pretty much sold at all the places that sell baked goods or sweets (they are even sold in the Market House on Main Street), but sometimes one shop might be out of them while another shop has plenty.
The cookies that I had were sort of soft. They weren't hard and crispy, but more chewy. They were quite hefty, too. Much more substantial than I thought they would be!

I wish they were holiday exclusives, but people have reported seeing them in August, May and who knows when.... I only go during Halloween season or Christmastime, so I always know I will see them.
