Question About A Crime

Boy...as if my week wasn't stressful enough. I just found out, from a very reliable source, that my ex-husband has commited a terrible crime. One in which he could receive the maximum of 20 years in prison (I cannot believe I am actually writting this). He is out on bail and the court date has been postponed (to exactly when I don't know). Now I have no contact with him or his family/friends whatsoever. My DD11 has little contact with him and no contact with his family. My question is this...

Are records of crimes that have not yet been to court public record? This crime is quite terrible and if he somehow gets out of going to prison he may want to take me back to court for time with DD11. If it is possible to get a hold of some info I can give it to my atty. Now I know all states and cities are different but I thought someone may give me some kind of answer.

I don't know if it's universal or if it varies from location to location, but arrest records frequently are publicly available. In some areas, arrest records, mug shots, etc. are even posted on Web sites and are easily accessible by the public. If you know what PD arrested him, I suspect you may be able to get a copy of the arrest report.
 
I know if I google " public records + arizona " I get a link to the supreme court of our state, where I can access all records, including pending cases. Not sure if there is something in your state, but it is worth a shot. This is totally free, and has tons of info. Good luck :goodvibes

Here in California I know many counties have case info(non-personal data) online, and in some counties it is FREE.
 
Here in NJ once the defendant is served the complaints are public record.
 
Yes, I agree with the PP. Get your atty involved. They can give you this info quickly and specifically for where you are.

Do a google search for the clerk of the court in your county. A lot times, it will take you to a link where you can search the court records.
 
Thank you for all the info. My atty is on vacation for 2 weeks...of course. I really don't care if you guys know what he did. I haven't been married to the man for 10 years. He was mean and abusive to me and my DD so he deserves what he gets.

He beat his wife up. He was so loud in doing it that he alerted the neighbor. He then threatened both wife and neighbor with a gun then physically assaulted neighbor. When the police arrived he threatened the officer with the gun and then physically assaulted the officer. They then found drugs on him and he was also high. His wife spent 2 weeks in the hospital. His mom paid the bail and he is now awaiting a court date.

He is luckt the officer didn't shoot and kill him.
 
Thanks everyone. I went down to the courthouse today and they gave me a list of all his cases. I have looked up the charges and he could go away for a while but heard most get pled down and most all time is suspended. I wish I had a lawyer handy to translate. Mine is on vacation AND she would charge me 200.00 an hour.

Unfortunately this is not always true. If there is no evidence of abuse towards his DD then he can still gain visitation. As wrong as this seems, it happens.

I used to work in a municipal court - what do you need translated? Maybe I or someone else here on the Dis can help.

Any judge who would let this guy have visitation with your daughter would be nutz! But having said that, I know it happens all the time. You are smart to be proactive in this. Do you EVER really get away form your ex? Not until yor kids are of legal age.
 
Just so you can have more info. Due to his actions against DD11 he has supervised visistation only right now. He has not exercised his right to see her since Sept. He is allowed 1 daya week supervised and as only seen her 3 times in the past 4 months.
