Purchasing Points From Reseller

We are purchasing OKW points from a reseller. I am informed that it is common for the purchaser to pay annual maintenance fees for unused points (above the agreed purchase price). This seems reasonable, but I wanted to make sure that this is standard.

You need to understand two separate explanations. First is that it is usual for brokers and sellers to ask and for the buyer to pay. Unfortunately, this doesn't make it right. Points are paid on an annual (Calendar year) basis. You are paying for each month, not for the points them selves. For example, if you bought a Dec use year with no banked or borrowed points and paid the dues, you'd be paying for 11 months that you didn't use. In this example, Jan-Nov would be for the 2002 dues and Dec for the 2003 dues.

As documentation, the Member guidebook says it's for a Calendar year and NOT use year. Aslo, if you buy directly from DVC you are prorated from the date you sign assuming you are getting points at that moment. Those buying SSR this coming may and getting a Dec use year, will only pay for 7 months but will get points all the way back form Dec of 2003.

This practice simply shows that the resellers either don't understand this aspect of DVC or chose to ignore it. It stems from the "pay the fees if you get the week" philosophy but is simply wrong. There are some very good and knowledgeable brokers that will tell you the opposite, but they are simply mistaken.

You should look at the overall deal and package and decide what to do. If you're getting a lot of extra points and it's truly a great deal, you may be better of just proceeding. With many deals though, it's a make or break it issue. I've bought resale 3 times and never paid the fees. You must decide if it's worth risking the deal or not. If you post the specifics (price per point, points availability, etc), we can tell you what's reasonable.
 
Ultimately you are negotiating with disney. Comes down to how important it is to get these points now. If this would be your first contract, and you don't want to rent points, and you want to quickly book a vacation you need this contract. If this is a second or third contract and the deal falls through or disney buys the contract, you have time and it doesn't matter. There is no cost to having a deal fall through except for the waiting. If you can afford to not get the contract, negotiate tough terms and eventually one will slip between the cracks.

210 points at $65.50/point (+$500 closing costs, + $3.50/point maintenance) which would make an effective price of about $71/point. All 210 ponts are available in 2003. The points have an October use year.

Another thing that I was thinking was that I should have the price reflect a total price of $71/point (with seller paying closing costs and 2003 maintenance).
