Point discrepancy

Ok, so we buy through the Timeshare store for OKW - 310 points PLUS 302 points leftover. Good idea. Settlement was last week. I call Disney today to make reservation and find out that there is not 302 points left over (like our contract says) because the original owners used half of it for another trip that they booked before settlement.

My paperwork can't be finalized because there is a discrepancy in the amount of points I'm supposed to have, and now I can't book our first trip home until it's all clear.

MY DH said this would be a problem ----:confused:

Now have to wait (again) until it can be straighted out.

Sounds like an ugly situation. I vaguely remember someone here saying that when a contract changes hands, all reservations using those points are cancelled.
Of course, that doesn't help you much, as the contract can't change hands! Kind of a catch 22 here.

If the trip hasn't already occurred, get in touch with your broker and insist that the reservation be cancelled. Could just be that they booked 11 months out before deciding to sell, and have neglected to cancel the trip.
 
Wow that is crappy hope you get the points back or atleast a monetary reimbursment from the seller for it.
 

Boy, that is really ugly. I noticed when we closed, the paperwork for the title insurance said that they do not guarantee banked points.

I would not waste any time at all. Contact your broker. Insist that the funds are not released to the seller until this gets straightened out, also give them a time limit to get it handled. If the sellers used the points up (which is how I read your msg), some money needs to be returned to you. You may have to negotiate how much. You could also instead say you want the contract voided since the sellers did not convey what was stated in the contract. Playing hardball on this issue may cause the sellers to start being a lot more amenable to working things out.

I 've contacted our broker - he's in contact with the seller and with Disney - I'm hoping this will all be straightened out tomorrow.

It's just that we were so looking forward to booking our first trip home after reading all the positives on this forum. It's put a bit of a downer for us. DH and children are not happy campers about this. :sad2:

My guess the funds have already been released. And as noted, the closing agency and title insurance won't guarantee the number of points available, only the number you get each year. Sounds like the seller listed it with a resale company and while waiting for it to sell, booked an completed a trip. Basically they used part of the points you thought you were getting. If this had been listed a while, it could be an honest mistake. Or it could have been done intentionally to put on over on you. I'd definitely call the closing agent and the broker. I do recall this happening once before and the broker made it whole, seems that was TSS as well. Also ask DVC if they will complete the transfer as is and you can argue with the broker and seller later; that way you'd at least be able to book your trip. Worst case scenario is you lose the points though I suspect that's not likely. TSS could also transfer points to your account if they have any contracts they own themselves or could make arrangements with a seller that isn't likely to use them.
 
you could have them purchase rented points to replace those
