Please help me with an ebay problem

I purchased a set of books on ebay that were advertised as a complete set of a popular learning series. The seller's store claimed all items are either brand new or just like new in great condition. The picture on the auction showed a brand new set in great condition. Well I received the set and a couple of the books are worn and dirty, one is missing. All the books in the set smell terrible like they have been stored in a damp basement for years. This is a big problem b/c my daughter has asthma/allergies and is very sensitive to smell. The cases are even damaged.
I know some may say that it will not affect how my daughter will learn from the books but I would argue that in fact the smell may even prevent us from using them at all.
I have written an email to the seller to see if he will right the situation. I am not looking for my money back, just an exchange for the quality book I purchased. If the seller does not agree to this what recourse do I have? I know I can leave negative feedback but that doesn't really help me!
BTW This seller has over 5000 feedbacks with over 99% positive.

You definitely have the right to return the product to the seller and ask for a new/like new set or get a refund.

If the seller is uncooperative with your request then what you can do depends on how you paid (check/credit/Paypal?).

I paid through Paypal. Thanks for the advice, I am keeping my fingers crossed waiting for a return email.

If you paid through Paypal there's a very good chance you will get you money back if the seller is uncooperative. Just make sure that if you haven't resolved the situation within 30 days of the auction ending (regardless of what the seller is telling you) you file a complaint to protect yourself. You can always withdraw a complaint, but Paypal will not do anything about complaints filed after 30 days regardless of the circumstances.

5000 positive responses are not easy to earn- I wouldn'y worry too much- it sounds like you are dealing with a good vendor- I just wanted to say that if it is Hooked On Phonics- if you return this set make sure to get another set- It is great. You could teach a monkey to read with that program. (Not implying that anyone's children are monkeys)
