Paltrow trial

I read about part of the testimony where she questioned it possibly a sexual assault and figured that was just during the first few seconds wondering what is happening here.
 
This is why eye witnesses are the worst. Each side presented an eye witness, one said she ran into him and the other said he ran into her. I do not see anyway that either party is going to "win". Basically this is a complete cancel with neither party being called guilty of the collison nor either party being absolved.
 
I‘ve had a snowboarder collide with me. It happens so fast. Like a split second. The extend of his injuries, I really question how she could recall he came from behind and skied between her skis and she heard grunting enough to ID him as male. It doesn’t ring true with my experience.

I thought that was super strange that she and the instructor skied off since he was laying face down unconscious. The whole event is strange.
I could be totally wrong, but is that still a disputed thing him being unconscious facedown? Is that fact in the case now or is that what he claims? How could he make the claim It was a hit-and-run if he was unconscious?
 
She is hard to take I can't even dial into the story in passing. What I know is of headlines. The whole conscious uncoupling thing was so coldy psycho I can totally see her mowing "the little people" down and taking off unbothered, just yikes.

That’s what his witness said. I also think it‘s very odd that he seemed so aware right after a period of unconsciousness. That doesn’t track with me.

I really don’t think the jury will find for either side. Too many things which don’t add up.

I’m a brain injury nurse. I’ve never had a single patient with such an intact memory after a such “life altering” (as described by his family) brain injury. Particularly the events immediately before and after the head strike. And post-concussive syndrome usually resolves. This is what? 7 years later?

But I’ve been wrong before and don’t know the exact details. It is sketchy to me though.
 
My opinion while we wait for a verdict: Neither party wins. From the snippets I heard, I don't believe many aspects of what the plaintiff stated. I think Paltrow's defense team presented the strongest case, but I don't think she'll get her 1$ that she is asking for.

From reports of cross examination yesterday, not surprising. He did a lot of travel including zip lining since his injury.
 
Did she get awarded attorney fees? Ouch. That’s going to be expensive.

::yes:: Not only did the guy NOT get the $300,000 he dropped the suit down to, he is probably paying out way more than that amount in Gwyneth's attorney fees, (not including his own.)
 
I’ve watched a lot of the case.

He had previously been diagnosed with cerebrovascular disease.

He told the people on the slope that he felt ok, then realized at the bottom of the run that he wasn’t ok. He had multiple rib fractures from the collision.

There may have been GoPro video of the event that was alluded to in an email to him from his daughter but for some reason no one knows where that might be or if it was destroyed evidence. (The jury was instructed that if they believed it was destroyed by him, they could assume that it did not show evidence in his favor.)

He went skiing since the event. And SCUBA diving. And traveling to Marrakech and Thailand if I recall correctly. He posted about his adventures on social media.

He also made multiple inconsistent statements and blamed his head injury when it was convenient.
 
Possibly this guy felt that Paltrow’s oddball beliefs and behaviors would work against her.

She should have countersued for $10 million to scare him away.
 
He also claimed he was unconscious for 5-10 minutes. That's an excessively long time that likely would have prompted immediate attentive and continued care from the ski resort. It was determined he was likely out for seconds if at all. Just a money grab.
 
I only saw some clips here and there, but it sounded like he ran into her, she screamed and possibly was indignant about being plowed into......I would have been too I think. He seemed like a jerk quite frankly. One of the funniest parts was when Paltrow's attorney asked this guy to answer a bunch of questions with just "yes or no".....and proceeded to show the dozens of photos *post* accident where this man was literally traveling the world. He put this all out there on Facebook....lol. And not only was he traveling, but he was scuba diving, zip lining, rafting down the amazon river, taking multiple trips to Europe, visiting escape rooms, lots of photos of him out with his "drinking buddies".....and he even had a personal breathalyzer with him to make sure he could drive. Seems like someone who has not suffered a traumatic brain injury.

I saw Paltrow walk over to him and say, "I wish you well"....after it was all over. She didn't need to do that by that point...she had won the case. And I do hope he has to pay her attorney fees, because it was a frivolous suit on his behalf.
