I drafted several pithy comments about the complaint and her counsel's qualifications. I'll just say that some of my most thoughtful posts are those where I don't click on "post reply."

Seriously though, the jumping back and forth between first and third person was really disturbing. A lawyer actually wrote that complaint?

They're in the first article linked to, or at least the back half, and "spiked pumps" is dead accurate. Her hair is poufed a couple of inches higher than I've ever seen in a Disney employee, but I have no idea what their "behind the scenes" rules are.

I join you in wanting to know whether the colleagues are temps. Speaking as someone who spent a decade happily temping, much of what she complains about is pretty standard if you're the only temp (smaller space, don't have own printer, etc.). I find the "holiday card" story really weird. I worked one place through two Christmases, and never expected to be part of that sort of thing, even though I got along great with my coworkers -- temps generally aren't even asked to the in-office Christmas parties, let alone included in photos. I was sometimes included in card signings or birthday lunches and stuff like that, if I'd been there a while, but it was pretty random and I never expected it.

It sounds to me like "Plaintiff" never understood what being a temp is all about. She says she "hoped for a long lasting and bright future at Disney," but she never worked for Disney, she worked for the temp agency, at Disney. She'd been there over a year without being offered a job, meaning any hopes of staying there long term were pretty futile.

I am not a lawyer and don't pretend to be one, but if she never actually worked for Disney, then I don't see where she has a case against Disney. I would think she's got a case against the temp agency, if she has any case at all (if she told Shanna she was dealing with racial discrimination, Shanna should have looked into it or just found the Plaintiff a different job). Which is not to say Disney won't pay her just to keep their name clean, of course. But if I'm right, I hope they won't.

As soon as I read "rambles" in the original post I knew Billy Madison would be making an appearance ;)

I myself am a contractor. We are contracted with no limit on term of employment, meaning an open ended contract.

Now, being a contractor AND working in IT, here are some things that I found in the complaint that needs to be clarified:

1. Not receiving emails. Contractors are normally given a temporary email so that they can do their business. I am constantly being left out of company-wide emails because I am a contractor. This may well be the case here with the plaintiff. She may be left out because a) Disney is NOT her employer - the temp agency is b) someone left contractors out of those emails on purpose - which is their right.

2. Not being invited to company functions. Everyone in my company gets a yearly invite to the company Christmas party....unless they are a contractor, we are never invited. EVER. This is because...again.... my employer is the agency, not the company I happen to work inside of. Our client is not obligated to do anything for me.

3. Since I am a contractor, I get invites all the time - for things that do not pertain to me, and a few minutes later someone realizes their mistake and rescinds the invite. Do I get mad? nope! The HR department here sent a letter out to every one in the badge database (meaning contractors, volunteers and permanent employees) stating that everyone in the hospital will be getting a $500 Christmas bonus this year because of cost cutting measures that we all participated in. Then they sent out a correction two weeks later stating that only full-time, permanent employees would get the bonus. It was an honest mistake - they sent out letters by accident - and I understand because I am NOT THIER EMPLOYEE - I work for an agency (who would never ever ever give us any type of a bonus lol, or even a Christmas card for that matter).

4. Her claim that a meeting was held about her without her there was interesting. Someone sent out an invite by accident apparently. That was a big mistake, because in reality, they were probably thinking about letting her go a while ago, and that meeting was to discuss that fact. This tells me she is not at all innocent in this. It is not always so cut and dry to terminate someone in a contract position. The contracting company can't fire you without telling the client and visa versa. The client can initiate a termination, but in the end both parties need to agree to the decision, otherwise the relationship can be in jeopardy. When she said that the agency had no clue that she was being fired tells me she did something very bad and is not fessing up to it.

5. The perceived right to a going away party. I have been working since I was 14 years old. Never once in those 29 years have I EVER seen a party being thrown, or a card being given to any employee of any race that has been fired. Retirements, Birthdays, Transfers and even before and after vacations - but never a "sorry you got fired" party. This poor soul is delusional.

6. The EEOC complaint could not find clear evidence of federal law violations - another red flag because the EEOC is very keen on slapping employers around, the whole purpose of the EEOC is to punish offenders - and they love doing it too. Them not finding a violation makes me think there is no merit to this.

7. She states that all administrative avenues were exhausted. I saw no reference of a written complaint. I saw no letters to the plantiffs. Speaking to a supervisor in this day and age are not enough. If you are serious - put it in writing. That will get their attention. Company policies always state that if you have an issue - follow these procedures, which normally includes filing a formal written complaint - which I see none of.

8. This is about the worst case filing I have ever read. She seriously should get a different set of lawyers. They made no attempt to make the case filing editorially or grammatically correct. These lawyers were probably found in a trailer on the side of the road somewhere with a sign out front saying "Better Call Saul".

If I was on her jury - just from the brief alone - I would not give her a penny. She better hope her lawyers come up with some damning evidence, else this case will not get very far.
