I got my member cards shipped from Disney yesterday. Did you all know that I've been a member since August of 1999! And I've still got the back up cards Bernard had printed for me when we visited Disney. So, I'm in great shape.

Congrats! Our member cards arrived in today's mail and we've been members since 1995. I checked and that just happens to be when my seller's originally purchased our contract from DVC. Seems really odd to do things that way. I'm glad to hear that they are using that approach with others too.

My DH isn't going to be a happy man tonight. I called the TTS + the closing company. Somehow, this fell through the cracks. I will fill you all in with the details:

About 2-21 we purchased 150 Beach Club Villa points with December use year. 34 points available now and 150 coming in Dec. 08 for $86 a point (seemed like a good deal!!).
On 2-26 Contract was emailed to us. We sent our deposit and waited for ROFR. I think it was about a week later that they found out the contract number was wrong. They had to send another contract to be signed.
On 3-28 Disney finally waived Right of First Refusal!! Yeah!!
On 4-18 TTS sent us the closing documents to be signed. We sent them back immediately (aware that we are very close to our deadline for booking Easter next year!)
Waiting, waiting, waiting to hear something, I checked the board yesterday and got advice.
Today, I called the closing service company. THE SELLERS HAVEN'T SENT THE PAPERWORK BACK!!!
I know NOW that I should have kept a closer eye on this. But with a bunch of kids at home, it just slipped past me. Not until I started booking the plane tickets for next Easter did I start to worry. So, now I have 5 tickets to WDW and no hotel room. I talked to WDW today and they are sympathetic, but said I needed to book soon or there won't be anything left for Easter.
Jerry Sydow is sympathetic too, but said the only thing we can do is back out of the contract! No legal recourse (it wouldn't be worth it).
So, Everybody Needs to Stay on Top of This!! Don't do what I did and figure that everything will be taken care of. Once Disney waived ROFR, I thought I was home free. Believe me, you don't want to be one of the ones who "falls through the cracks".
Hopefully, next week the seller will send those documents like he promised. It still sounds really fishy to me. Meanwhile, we are already paying on a loan for points that we don't have.
I'm going to have to get rid of the kids, have my DH's best dinner waiting tonight, open the Miller Light and put it in a frosty mug before I tell him this one (lol). Somehow I don't think he'll be amused! Can you believe it?

Offer accepted on 13th April, ROFR passed 25th April, closing package received 10th May, welcome home today... and we had to send the funds from the UK!

Things certainly seem to have gone smoothly for us - hope that many more of you can share our good luck

I have to wonder if buyers now should have some representation when purchasing. We all think this is just a timeshare, not a physical house, and the process shouldn't be that complicated. Yes, we sign a form to waive buyer representation, but the broker is to act like a transaction broker and work in the best interest of the deal, not necissarily the buyer or the seller. There should be a date stated in the contract that specifies when the seller must return all documentation. If they fail, you are not obligated financially and all your monies returned to you. Of course, the brokers will talk you into extending, just sign another form. The seller is out nothing, the buyer is the one who is inconvienced. If you had representation, you would have been informed of all these options, and probably instructed not to purchase anything until after closing.

Yes, I think it really is alot more complicated than it sounds! Now we are paying for this loan on something we don't have. The TTS will refund our money, but when we pay off the loan early the bank has a fee. Plus there is immeasurable inconvenience on our part! I thought they would hold our checks until closing, but that wasn't the case. Now we just wait and hope the seller comes through. It is possible that he changed his mind about selling and we will be stuck!

Oh, now is the time that I'd be playing hardball...

As soon as your contract hit estoppel, the seller can no longer use the points. I'm not sure what would happen if they changed their mind this late in the game, but I'm sure it would be a PIA for them to get their points back.

I'd be calling my rep at TTS and telling them in no uncertain terms that if the contract isn't returned signed by the end of the week that you will be backing out of your end. That will move everyone along in getting paperwork settled up. If not, I'd keep the money in their escrow account and buy another contract ASAP.

Good morning all! Got an extra hour of sleep today!! Laxlad started exams so doesn't have to be to school until 9:30.

It is funny to me that so many people sing the praises of TTS. My experience with them is what a lot say they had with GMAC. I called them looking for a contract, as I did all the big resellers, and the guy tried to talk me out of HHI and was not friendly at all. I felt more like an inconvenience. He said he would add me to his list. It seemed like he didn't want to deal with a small contract like what I was looking for. I wasn't impressed with their customer service.


I just heard the saddest news. Stephen Curtis Chapman's daughter was struck by a car and killed. Maria was 5 yo. They just reported it on the news. My heart goes out to him and Mary Beth. And we were just talking about him here yesterday.

I don't know much about it, but I've heard some say that there are sometimes possibilities to spend a little more to expedite the closing process. If that is available, you might want to push the agent to cover the costs of such an expedited process - they really dropped the ball here. I'm sorry you have to deal with this.

I would also suggest putting a thread to this effect on the operations board. People need to be aware of this. Good luck!

Wow...I can't believe you sent your paperwork on 4-18 and you're just finding out today that they never got anything back from the seller. Unbelieveable!

OK, just threw all my plans up in the air....I'd planned that next May DH and I would take a trip to BWV, then in June I'd take my daughter ( just like this year) to AKV...see if the GFs are up for another F&W and then Christmas at BWV ( getting a 2 bdrm to take my Dad and Mom )...

Well, spoke with my Dad today and he's afraid we won't get to time the Xmas trip correctly, so he wants do do a family trip in June...Which is fine...except there goes my idea of AKL concierge in June..( Dad wants to stay at BWV so we can walk to the parks..) AND I have 50 07 points that I need to use by June 1st...ACK.

Back to the drawing board...

I hope you are able to figure something out. I'm just jealous. I wish I had so many points I didn't know how to use them all!

Ed. I'm at 200 which is definately more than I need...However, I'll work it out. I save lots of points by staying in studios and the fact that I work every weekend ( so I only take weekends off for divetrips )

I'm so sorry. I really don't know what to say. What is up with these (beep!) sellers lately?! For what it's worth I'm sending some extra good vibes your way hoping your sellers will step up & do the right thing. I wouldn't let TTS off the hook so easily either. They dropped the ball big time.

What's the tally so far? THREE of us in just the past couple of weeks, with sellers that can't get the paperwork in, so they can get their (OUR) money, and we can get the contract we are paying for! And this one! To go on so long, without a call from the company, to update you and alert you there is a problem! Excuse all the !!! It's been a rough day. Glad you called, or you STILL would not know what's going on.

But don't take it out on the kids ("I'm going to have to get rid of the kids."). It's not their fault!!! (More !!! I'm typing like an eighth grade girl.) I hope the Miller Light helps. And, again, congratulations. Now, if you haven't heard anything about estoppel in three weeks, call. Then, after you sign your contract AND SEND YOUR CERTIFIED CHECK, call within the next week to confirm that the seller has sent their docs back...and if not, keep calling at least once a week. Learn from our mistakes.
