So a family in my neighborhood got a golf cart for Christmas.

At 8:30ish PM three 16 year old girls were out for a ride. The driver was going so fast that when she entered a cul-d-sac that when she turned she threw one of the passengers off the golf cart. Moments later the second passenger jumped off before the golf cart collided with portable basketball goal.

Here are gif clips of the videos posted to Facebook. I could not figure out how to download the actual videos.

In the top video you can just make out the person getting slung out of the golf cart in the sharp turn. The second video starts after the first person has already been slung out and you can't see the second person jump out because it happened behind the bushes but you can see the second person getting up and walking towards the golf cart while the person in the middle slowly gets up.

On the original videos you can hear the girls all scream when the sharp turn is made and then hear the driver say the brakes didn't work, she pressed them but nothing happened.


Here is the drama.


The parents of the driver of the golf cart is asking for the owner of the basketball goal to pay for the repairs to the golf cart and saying that their children were in no way at fault.

Obviously the golf cart was being driven in an unsafe manner. If the basketball goal had not been there the golf cart would have jumped the curb, hit a mailbox, and a tree. What if that had been a parked car instead? In Georgia you can drive a golf cart at 16 with a learners permit. The driver of the golf cart is 16 but does not yet have her learners permit so can only legally drive the golf cart with a 18 or older licensed driver present. The other passengers were also 16.



I don't understand how the result of this accident is anything but the parents of the golf cart driver saying: "I am so sorry. What can I do to make it right?"

In your opinion who is at fault?

LOL! Well, I'm assuming that the *parent* of the golf cart driver, is asking for the owner of the basketball court to pay for repairs. And if that's the case...the parent of the golf cart driving teen....is a lunatic. I would have laughed out loud at the request. What a world.

Well, since the driver of the golf cart was driving illegally, they would be at fault. But goes to show how important a good homeowners insurance policy, and an umbrella policy, is. They could very well go after the homeowner and you want to make sure the homeowners policy will protect the owner. Also, the owner of the golf cart should have added the cart to their homeowners policy as well prior to driving it.

But, in this case, 100% the golf cart owners fault and the homeowner could take them to small claims court for damages to their basketball hoop. I hope the police were called to make a report.

100% THIS.

And, if I was the person who owned the basketball hoop I'd tell that Golf cart owner to go pound sand over their request to repair the cart! Wow - that takes some you-know-whats!
 
The driver is at fault. They were out of control and the hoop was stationary. It's no more the hoop's fault than it would be if it were a fire hydrant or a mail box. If I were the owner of the hoop, I'd say you're not getting a dime from me. further, you will replace my basketball hoop. And if that were my daughter, I wouldn't let her drive until she's 40 after that.

It looks like the basketball hoop is inches away from a mailbox. If they hit a mailbox (or a tree, or a car...) would the parents be asking the owners of the mailbox/tree/car to pay for the repairs? If the 16yo hit any of those items with a car instead of a golf cart, would the parents also request the owners of the stationary item rather than the driver to pay for the damages?
 
OMG.....it always shocks me when people do not hold their children accountable for their actions.
Parent of the kid driving the golf cart should have their kid pay the owners of the basketball poll money to fix and repair the poll they ran into.
Shame on these parents for teaching their kids that they should point the finger to somebody else instead of looking in the mirror to see who's at fault.
I'm not a perfect parent, but I definitely know that if my kid ran into my neighbors property I would be mad at my kid, not the neighbor.
 
I mean, do you have a HOA that prohibits leaving a movable basketball court up against the curb in the street? If not, the driver was at fault. She was out of control in the video...easy to see she's not ready for Daytona quite yet. ;)
The HOA covenants specifically allow portable basketball goals but I am not sure what local ordinances say about placing it in the curb area of the cul-d-sac.

Googling seems to indicate the police in many states have some leeway as to whether to ticket someone as long as the goal is placed on a limited access street that gets limited low speed traffic. The expectation is that it is not a traffic impediment.
 
Total guess here... driver went home and said the basketball hoop was on wheels and rolled in front of her, so she was unable to stop. Parents believed her. After seeing the footage, they are calling 'fake', because their daughter would never lie about a thing like that.
 
Looks like you neighborhood Facebook is more interesting than our neighborhood Nextdoor site. That is usually filled with porch pirates stories and people not wearing masks.
 
Owner of golf cart may be sorry they've opened Pandora's box. Depending on local ordinances and whatever's been codified into law basketball hoop may have certain amount of liability, but owners of golf cart are exposed on many fronts.
