He is feeling a little better, and trying to wean himself off his pain meds. Not too bad!! The guy that beat him? Well we found his pic online where he was arrested, and he is 38!!! REALLY??? Who at 38 beats a child??? We are going to write to congress and reps here in our state as well, as we found out because my son is 13, it is NOT abuse of a minor, because he is older than 12!!!! WTH??? They ARE pressing charges of aggravated robbery, and there is another charge from someone else as well, AND he is on parole, so the officer said he IS getting prison time. I will keep updating as things change. TY TY TY for all the prayers...they are working!!!!!

Can they charge him with child endangerment?

That is so wrong! He is still a minor. That needs to be changed. So infuriating on top of everything that has happened. I'd get that guy for everything possible; assault, attempted murder, anything that would stick.

We found the other guys pic online where he was arrested as well!!! FINALLY!!! HOWEVER, my son looked at pics today and says the 2nd guy is the one that beat him, and shook when he saw the pic We called the police station today to let them know, and they are supposed to get back to us today. I am NOT letting this go!! Beating a MINOR, no matter WHAT the law says is a MAJOR CRIME!!! I will make sure a new law gets passed if I dont sleep until its done. Watching my son not get to ride rides at a fair due to broken facial bones, play games because hes too tired, and shake at the mere sight of the mans picture INFURIATES me. Hes resting tonight, and wants to go to a concert he had planned on. We are going to see what happens when he wakes up, and how he feels, and let him go WITH AN ADULT to the concert for about an hour, but thats it. He tried last night to hang with some friends but after a little while sat on the ground with his head in his hands from the pain. Hes on 1000mg of Hydrocodone every 4-6 hours. His eye is more open today, but the skin is even more bruised and dark r/t blood under the skin. Ill keep updating as we know more. Im at work tonight, (which is killing me) but my wonderful bf is at home with him, not letting him out of his sight. I am so blessed to have him in my life right now.

went to the eye Dr today. He says no surgery needed, but keep watching for signs of retinal detachment. He says the blood in his eye will take 7-14 days to dissipate, the black eye will take weeks. We go to the Dr. about his nose tomorrow..

I just wanted to say my heart goes out to you, your son, and everyone else affected by this terrible act of violence! I have a 13 year old son myself, and he is a CHILD! I am horrified to think someone would be charged with a lesser crime because he's not considered a CHILD!

I have a lump in my throat and tears in my eyes. Your family is in my thoughts today.

Aggravated robbery is a very[ serious offence.

In Arkansas it is a Class Y felony subject to a minimum of 10 and no more than 40 years, or life in prison. That would be for a first offence.

A Class Y felony is the most serious class of felony in the state of Arkansas. For comparison sake, Murder in the First Degree is also a Class Y felony.

Arkansas has enhanced sentencing for habitual offenders. Depending upon the nature of his prior conviction (felony or misdemeanor? Violent?) and the number of prior felonies, the minimum sentence for aggravated robbery could be as high as 40 years.

Finally, depending upon the nature of the crime against your child, additional charges could be filed such as battery. If convicted on multiple charges and if sentences are ordered to run consecutively, then the prison term could be substantially longer. This could add 5 to 20 years in most cases.

Edit to add: Arkansas also allows for an enhanced penalty for committing a battery in the presence of a child. In this case, if your son was assaulted in the presence of a friend under the age of 16 then, upon conviction for battery, an additional 1 to 10 years could be added to the offender's sentence. The added enhancement under this section must run consecutively to the battery offence. Early release, parole, or community correction is not permited for this added 1-10 year enhancement.

TY TY TY!! I am definitely going to talk to the prosecutor about this. They are still in jail today with a $50,000 bond. Charges are: second-degree criminal mischief, terroristic threatening, theft of property and aggravated robbery. One also was charged with public intoxication. Like I said we are not letting this go.

We went to the ENT doc today, and she said it was the worst swollen broken nose (inside) that shed seen in a very long time. She is going to review CT scans today and get back to us today or tomorrow to see if he has to have surgery Friday. Shes thinking no, but said she needs to double check. Either way, she says his nose will never look like it did before.

The prosecutor sent papers today for crime victim compensation, but I have to call her, as we don't know how much time to put for my missed work, as the court case hasn't begun yet.

We have a long road, but were in it for the long haul. TY everyone for prayers and thoughts! He went to school about 10am today after the appt., and was in the nurses office before noon taking Ibuprofen, as he can have that inbetween the pain meds. I'll keep you updated as I know more!

Went to the Dr...the cheek is also fractured as well as the base of the nose. We were sent to Childrens today, and told we have to be back Monday morning for him to be put under and have his nose reset. He has to wear a small "clamp" on it for a week, and it will take 4-6 weeks to heal. One of the men bonded out, and they did show for court today, and pleaded not guilty. I will try and keep this updated. Just please keep my son in your prayers!

Thank you for the updates. I am sorry for your DS's injuries and pain! I continue to keep your DS and your family in my thoughts and prayers. Once he is pain free and recovered, I hope he will enroll in karate.
