My Neighbors Dog killed my Puppy!

Two weeks ago my husband and I were discussing getting puppies, he wanted a big one, I wanted a little one. We were also discussing how much we could afford on these puppies, we decided we were getting two so they would be friends from the get go. Well I found a Pomerian for $350 and he found a Boxador (Boxer Lab mix) for $50, so we decided that we could swing that.
Well last night my husband took out our puppies into our fenced in yard then he came back in to give me the phone when he was done talking, as soon as he walked in we heard Chewie our pomerian yelp so he turned right back around to check and see if the two were fighting. He was litterallhy in the house maybe 30 seconds. When he went out the neighbors dog had Chewie in his mouth, he pulled her under the fence. So my husband jumped the fence and the dog dropped her, he then scooped her up and knocked on the neighbors door and told him what happened. The neighbor comes out looks at his dog and says "Bad Dog" seriously!
So we had the police, spca, and the landlord from the neighbor next to us at our house last night.

The landlord doesnt even allow anilmals she didn't know they were there. The police said there was nothing they could do it was a civil matter.
The spca said they could cite them with a dangerous dog. And that we should contact a lawyer to get reimbursed for the dog.
The Landlord told him he had to make things right with us and get rid of the dogs within a week or move out.
The neighbor still has not said anything to us.

Has anyone ever had this happen, if so what did you do?

No, never had anything like that happen or heard about it.. but i am So So sorry for your loss, what a horrible thing..hope someone has good advice for u.

You can take them to small claims court for the cost of your dog.

My sil's little yorkie got ripped apart and killed by 4 large wolf dog hybrids in my inlaws own breezeway. The dogs were owned by their neighbors about 5 or 6 homes down.

Cops were called so was animal control because my bil got bit and my mil got hurt...2 of the 4 dogs were put to sleep on the spot...

It was such a horrific moment...I'm so sorry that you had to experience it..

I was at the police a week before we got the puppies because the dog could reach our fence and it was scaring our kids. The one day my daughter was so scared that she went running and ran right into the foundation of the house (she is only 15 mos) and scrapped the whole left side of her face. They told us there was nothing they could do it was a civil matter.
The SPCA said that they would cite them for having a dangerous animal but not put it to sleep.

It's too bad there was a space large enough for another animal to get under the fence in the first place and get your puppy. You can probably recover the cost of the dog, providing you have a receipt, in the event it escalates to small claims court. Hopefully you will find some comfort and companionship with the one puppy you have left. Don't be tempted to buy him or her a 'friend' right now. Just enjoy having one and integrating him into your family. I'm sorry you lost your pet.

We could not believe what was happening.

Thats the thing their dog dug by our fence ane there is a slight incline going into their yard so their dog didnt come into our yard and just snatched Chewie when she next to the fence she was only 2.5 lbs

Our neighbors dog killed my cat. Crushed her to death. They saw the whole thing and they did apologize but that was it. Their dog was taken from them, we had hearing and the dog was deemed dangerous. They had to take a bunch of steps to get their dog back (up the homeowners ins, let the ins know they had a Pit Bull, get a certain type of fence, get a certain type of enclosure to keep the dog in, etc etc). Well they take all the steps but then they got rid of the dog......I was soooooo happy when he was gone, I worried all the time about that dog and my kids...and ME!! He used to jump their fence and he chased me into my house once when I didn't know he was out, he was scary!!!! Anyway, they got rid of him and got a small dog, then about 6 months later they got another Pit Bull, this one also lives in the backyard and gets NO socialization and has gotten out and chased me.....in my OWN yard......it's absolutely ridiculous! I never received any type of restitution for their dog killing my cat, not even the fee to have the cat's remains taken care of. I certainly hope your neighbor gets rid of the dog, if not pursue!!! And I certainly hope the landlord makes them vacate if they don't get rid of the dog. To get any type of restitution you will need to take them to small claims court. We decided not to pursue after our neighbors got rid of their dog.
Oh and I'm not a dog hater, I've got 2 of my own, I'm also not a Pit Bull hater. Good Luck OP, I am so sorry you had to go thru that, it's horribly traumatic!

I guess I don't have a great idea of what kind of fence this is, but if there was a gap anywhere that was big enough for your puppy to get through, be prepared for your neighbors to claim your puppy was in their yard. Not saying it will happen, but it's happened before.

OMG I am SO SORRY this happened to you.

You need to DOCUMENT everything....Send a letter immediately to the landlord and the tenant and ask them to turn the letter over to their respective insurance carriers to seek a claim. You can sue him in small claims court instead, but the reality is, you still lost your dog and getting some $$ will not help mend your heart.
That dog is considered being Vicious and carrier may TRY to deny coverage however they may just try and settle with you if you provide prrof of cost AND document your clamn (p/r, write up what happened, etc)

I know someone and same thing happened. The FENCE is required to have a WIRE along bottom (it holds it down and dogs cannot burrow under it) to AVOID allowing DOGS/PETS to get UNDER it in the first place, what a shame

I am so sorry for your loss. Your only recourse is small claims court. Pets are considered property, and you have to sue them for the destruction of said property.

Give them a bill for the cost of your dog, tell them if they don't pay, you will take them to court, and then take them to court and sue them, include your court fees too.

OP I am so sorry about your puppy. I hope he passed quickly and didn't suffer.

Is the fence yours or theirs? I would look into repairing/replacing or building up the existing fence.

First off, I am soooo very sad for you. Had to make that clear.

Next. A question, since we had a scary dog when I was growing up. Had all kinds of rules we had to follow to keep him. Was the puppy killed in your yard or the neighbors' yard? Because if it was in the neighbors' yard, you may have no lawsuit. Their dog may have stuck a head through and grabbed your puppy, or your puppy may have wandered through the hole in the fence to visit the neighbors dog.

Please don't think it makes this any less tragic, I just want to point out that you may or MAY NOT have the makings of a lawsuit.

I am so sorry for your loss. We have two "toy" size dogs and also have to be very careful with them. If you do get another one, remember that a hawk or owl can take a 2.5 lb. puppy so even replacing the fence doesn't necessarily keep them safe.

Yes, two similar stories. A sweet, tiny little stray made itself at home with my parents and grandmother. The neighbors' two german shepherds stalked him and attacked him several times. Dad built a miniature dog door into the barn so he would have somewhere to hide if the two dogs ever came around when my parents weren't home, and it worked a few times. Parents would come running as soon as they heard the ruckus and the little guy would be hiding in the barn. But the day finally came when they got home and he was missing, they guessed what happened and after two days of searching the property, dad located his remains. Nothing was done with the two dogs at the time, couldn't prove they did it, but following a later attack on another pet, the owners had the male (which seemed to be the ringleader) put to sleep. There were no more problems with the female dog.
On the other side of this, my best friend had a mutt that attacked and killed her neighbors' toy sized dog. She looked out her window and saw that he had gotten loose and then realized he was "playing" with something, tossing it then grabbing it again. She was sickened when she realized what the something was. Her neighbor was devastated. Her dog was put to sleep.
It would probably be more common, but most folks keep their dogs in a kennel, tied or fenced nowadays. I'm so sorry this had to happen to your little puppy.

Sorry- this may sound cold, but if you're going to get a toy breed puppy, you need to take special precautions. Inspection of the fence and looking for digging occurring at the base of the fence should have been done. If the dog was only out there for 30 seconds- there is no way their dog could have tunneled under or dug a hole that quick. THE HOLE WAS THERE. You have to bear some of the responsibility.

PS- We have 2 saint bernards, including an 11 month puppy that LOVES to dig. We can't even have parties in the backyard anymore cause it's the land of potholes.
