I loved the part about the iPod's inherent defective design and lack of sufficient warnings about hearing loss. Hello -- you concentrate loud music into ear-buds stuck just a fraction of an inch from your eardrum and you think that should be OK?

and if they refigured the player to ONLY play up to a certain decible (sp?) people would say "it's not loud enough".

the problem is...the earbuds that come with the iPod (well - with ANY mp3 player really)...suck. The sound quality, imo, is HORRIBLE!

I use my Sony "street style" headphones...the band goes around the back of your head and hangs over your ears (nothing IN your ears). The sound quality is MUCH better...lightyears better IMO.

The entire lawsuit would be a laugh-riot were it not for the fact that the lawyer and plaintiff are serious.

As for the warnings, I wonder where on the new iPod Nanos they'd find room for any label. I just bought one and they are slim and small. Maybe it could be engraved on the back?

Same type of case as the dumb lady that put a hot cup of coffee between her legs and sued, and won, a HUGE sum of money from McDonalds because she was stupid enough to put a hot cup of coffee between her legs while driving (I don't care how serious her burns were, it was still 100% her fault).

Isn't there a hack for the iPod that lets you increase the volume to unsafe levels? Didn't the engineers at Apple ensure that sound levels present in the ear buds were low enough to not damage hearing? Isn't it possible that this man is an ambulance chasing nutcase?

Sheesh. What next. Someone suing McDonald's because their coffee is too hot or suing Burger King because their fries made them fat?

I think someone was trying to sue the fastfood industry a while back.

I don't blame the lawyers in this country for all of these frivolous lawsuits. I blame all the greedy people who want something for nothing. Ouch. I think my keyboard just made my wrists hurt. Time to sue Microsoft. :rotfl:
