Level 3 Sex Offender Sues McDonalds and Mother

I agree that they have no business being around children (although if we are going to insist on letting them out, I don't know where it is we think they can go to avoid them.)

And I never said I thought what she did specifically was harassment... so not sure why that part was aimed my way.

All I'm advocating is a method that would meet the needs of all involved, while still continuing to act humanly towards the mentally sick?

I don't care if we put them in a hospital, on an island, or 6 feet under.

They have no business being around children, period.

I still do not see how it qualifies as "harassment" to report a public fact to someone's employer.

How does this work? I mean ok so I'm a level 3 (I'm not, but let's pretend), I move into a house that fulfills all of the requirements for my placement. There are no kids living anywhere on my entire block. I've almost finished paying off the house and someone decides to move their family with two kids in across the street... now what? Do I have to move, take a huge loss on the house and start over somewhere else?

Tough. Don't molest kids. Problem solved.

I think once someone has committed a crime if it can be proven that the root was some form of mental illness then they should be placed in a hospital for their own good until such a time as they no longer present a danger to someone else.

As for the "uncomfortable" hospital, perhaps it was freduian and I have more bitterness left over my experiences then I thought. Or maybe it was a typo. Either way - I meant to say COMFORTABLE, somewhere they can be safe and live in relative peace.


So are you saying everyone without a clean bill of mental health gets locked up in a hospital? Would we be required to have annual screenings? Do all kinds mental illnessses and instability, including things like PPD, equal life in an uncomfortable hospital? (Please, before you do that to me, sign me up for the death penalty instead!)

Just clarifying because originally you didn't mention needing to commit a crime to be locked up in a mental hospital. Unfortunately there are plenty of people out there that want everyone with a mental illness period put away. If we were to move to a life in a hospital type punishment, it's something we as a society would have to take care to be very clear about.

Those who have been criminally convicted have withstood the threshold of having the mental ability of being able to differentiate right from wrong, otherwise they would have been found not responsible by reason of insanity or not have even gone to trial in the first place.

Are they mentally ill? eh, maybe maybe not....but either way if they have a conviction they are not mentally ill enough to not be responsible for their actions...in which case boo hoo if a child moves into the neighborhood. Children are innocent, child molestors are not.
 
Since the entire thread was about a level 3 sex offender, I felt it was assumed that I was talking about these types of offenders. :confused3

I am a strong advocate for the rights of those with mental issues, it is a subject near and dear to my heart and I would never suggest that all persons with issues should spend life in a hospital. That said, with little to no chance of rehabilitation and the way this society tends to go into a lynch mob mentality the moment anyone utters the words "child molester" - I think keeping them in a safe, comfortable hospital they can get help in is a viable and humane alternative to the other options. (Death penalty, life without parole, or being treated like they are less then animals by the outside world. Not to mention the risk of allowing them out on the streets only to falter again.)

Given the state of mental health care in this society today, and given that most folks still don't believe in mental illness or it's ability to control the actions of some, I'm not about to believe that being convicted means not sick.

About the only type of mental illness I have seen stand as a defense is schizophrenia and maybe, just maybe, Post Traumatic Stress Disorder.
The illness of a sex offender falls more into the category of compulsion. Still a mental disorder and one that can best be treated by hospitals.

Regardless... there isn't a great spiritual leader, or teacher that hasn't decried the use of violence against those who commit violence, and who haven't spoken of compassion and forgiveness of even those who commit the most heinous
of acts.

Given that I prefer to maintain my humanity - by not forgetting theirs.

It doesn't make mc donalds safe because they fired an employee who is on the sex offender list.I worked for the same company napoli group at a mc donalds restraunt for three years.you would not believe all that i have seen.Managers smoking pot and doing coke with teenage employees,A 25 year old female supervisor sleeping with a 16 year old male employee.Once a parrent called to see where her son was and a supervisor told her he was working a little late when she new he was outside smoking pot.I did my own background check on employeesI found out a crew cheif that was charged with felonly battery.managers charged with drug possion he is also the manager that i have caught smoking pot with teenage employees.and also two employees that were sex offenders.I brought all this to the owners attention and nothing was done.If they got rid of all their employees who had criminal backgrounds they would loose a very large portion of their work forceThey are hipocrites to fire employees who are on the sex offender list with the other criminals that work their who are doing drugs and sleeping with the teenagers,Please research the place your teenagers work ,Stop by and see for yourself what goes on at their place of employment.I know i would never let any on my teenagers work for napoli group at one of their restrants.
 
I have to move past the point regarding if he should or should not have been allowed out of jail.

As it stands, he was released. He has rights to make a living. One can argue he should get help, so that he won't turn back to crime, drugs, etc etc.

Assuming he did disclose his history and his employee hired him, he should be protected by law.

Listen, I think the problem stems back to if a sex offender should be released, the how, the when and the big if. But he was and he as the right to be gainfully employeed. He stated nobody else would hire him. You sure wish he could be working in a lumber yard or something like that, but no luck.

I could see him getting a big lawsuit and winning out of this. Again, assuming the fact that McDonalds had full disclosure of his criminal record and chose to hire him. That mom calling should have ZERO impact on his employement after the fact. They allowed it to be and they don't get a "do over"
