Lawsuit against father in death of mother

I haven't read the thread. But from a purely LOGICAL standpoint, it sounds like a no-brainer. The insurance company would pay up.

Whether it should be done is a whole other question. Making money off of your parent's death is questionable. Unless you REALLY didn't like them and could care less, I would say that you would regret every dollar won in the lawsuit.
 
Here's my take, an d excuse me for not reading all the replies, BUT you did say the lawyer is going to sue the estate. Well if you already have settled the estate, you will be suing yourself and anyone else who got any money. Any if the lawyer wins, then you will end up paying hiom out of what you already gained from the estate and have even less.


Great plan for the lawyer, I hope he gets you for his third, if he is smart, he already knows how much is in the estate, and will sure for well over 3 times the amount. If he wins, you will end up owing him more than you already got!
 
I don't know why I keep coming back to this thread.

I dislike the handful of states that have invalidated the "household member" exclusion in an auto policy -- it allows collusion and profiteering over the injury or death of a famiy member.

I'm interested in what paperwork you filled out? Who made the detemrmnation of fault? The police department? A traffic safety specialist? Where there any witnesses? an autopsy? What evidence was used to determine fault?

The reason I ask is -- in a civil suit, police investigations, etc. may be considered evidence of fault, but they're not binding.

CRoach, I am sorry for your loss but this attorney and his whole plan just "smells bad" to me. I would not persue this.

While I respect everyones feelings, I am going ahead with the action and hope for a good settlement. Yes, I would rather have my mother alieve than the money. Though I can not bring her back and the money comes in handy.

I will gladly earn whatever money I have,

my Father taught me to respect myself and others as well..

if your father had survived the accident would you still sue him...???

as far as the lawsuit being morally correct,,the attorney knows nothing of morality
