I just submitted an offer for a BCV contract. I sure hope DVC doesn't exercise ROFL on it! I did a full price offer and from what I've seen from the history on the thread on this website, I'm hoping that it has a good chance of passing.

When you say you've submitted an offer, does that mean the seller has accepted it and it's now been submitted to ROFR?

As long as you're paying $84 per point, I think you should be ok.

Oops, you're right I wasn't very clear. I offered the seller exactly what they were asking - $85 per point - but I have not had that offer officially accepted by the seller yet. The broker doesn't think I'll have a problem with the seller, which is why I had already mentally jumped ahead to ROFR.

My DH, wdrl does keep track of ROFRs and has noticed that this month only 3 ROFRs for BCV have been filed with Orange Country Recorder. He has seen resale contracts for BCV come through but the recorded deeds do not indicate how much a contract is sold for. So it's possible that Disney is just not ROFRing anything that sells for more than $80 per point or whatever the going rate is on ROFR thread by Donald is #1.

Personally I take that's a good sign that you'll pass ROFR when it's submitted. Good Luck! Here's some pixiedust: to help you pass.
 
We too made an offer today at BCV and are waiting for a response. We bid over the asking price, b/c they were asking $80 and I didn't think it'd go through. Even though I don't care about the lost "perks", and would just as soon buy after the 20th, I have mixed feelings as to where the market will head at that time and would just as soon get in now.

So, we bid $83 on 200 points and asked the seller to pay the closing costs (this brings the cost down to right around $80, their asking price). Figure it's fair, would expect them to accept.

I'll be interested to see how Disney handles ROFR now since we are inside a month. I won't be holding my breath.

The sellers just accepted my offer, so on to the next step. I didn't even try to negotiate. It's a smallish contract (100 points), I'm also getting the points that were banked from 2010, and it's my current UY which was important to me. (With my pea brain it's going to be hard enough to manage two contracts, much less ones that would be in different UY's.) I wasn't in the mood to bicker back and forth for a contract that exactly met my needs and that I hoped would pass ROFR. (got it right this time!)
 
Under the new policy, Members who purchase from anyone other than Disney Vacation Development, Inc., on or after March 21, 2011, will not be eligible to use those Vacation Points to make reservations within the Concierge Collection, the Disney Collection or the Adventurer Collection. Those Vacation Points will instead be valid only for reservations at Disney Vacation Club resorts, as well as for RCI® exchanges, Club Cordial and Club Intrawest.

That sounds like a contract I was thinking about....April UY? Good luck. I like your strategy with the seller paying the closing so that the price stays higher to get through ROFR. I keep thinking that after the March change it may be hard to get a BCV contract. Regular folks may hesitate to buy at the higher price and if the price goes lower, Disney will scoop them up to resell at their price. I've been watching for a resale at BCV at the 100 point mark or slightly higher that's not stripped and April UY, but have never bought resale before, so have cold feet everytime I see a contract that might work.

It has been clarified from several sources that anything submitted to Disney before the 20th will be grandfathered.
 
n2mm, There are plenty at BCV available for less than $100. Disney seems to be executing ROFR around $82 and below. I've heard higher, but have also heard of a few going through around $81-$82. We offered $83, with selling playing closing since they were only asking $80.

I don't know what Disney's agenda is with this change. They've been giving me the hard sell direct, but I point blank asked the rep the other day why I would buy something for $115 a pt when it's going to be stripped down immediately, should I need to sell. She said, "Well the major benefits are still going to be there, most people use their points for villas or RCI". So, I asked why would anybody then buy direct? She didn't seem to have an answer. It was a strange coversation. I think their goal is to create the perception that there is additional value when buying direct. However, people are savvy and seem to have figured out that this really isn't the case. Personally, I think it would at least make sense for them to say that any contract bought after 3/20 via resale (minus perks) can only be sold minus perks; but if you bought or own a contract with perks, you can sell with perks.

Just submitted an offer for full price at SSR for $66 a point for a 150 point contract. This is our first DVC contract! I am so excited! It is out to ROFR.
I did not realize you could barter closing costs. I also did not want to lose the property to someone else who was willing to pay full price. :woohoo::cheer2:
 
we only negotiated the closing costs b/c it balanced out the numbers. we offered $83 for 200 pts at BCV, they were asking $80. We offered $600 more than they wanted, they are paying the $525 in closing.

We actually upped the offer to $84 per point so it's more likely not to get ROFR'd.

Our offer was just accepted (not surprising). I am awaiting the contract, we will get it signed and back today, hoping to get into ROFR by tomorrow.
 
We actually signed the contract on the 17th of Feb. We will hear something on or around March 15th. What do you think of this package, it had 150 points from Dec '10 + 12 banked points for Dec '11 with 138 more points available in Dec '11 along with the full 150 in Dec '12. Hoping to take trip in August in a studio and then off to Hawaii next year with banking and borrowing! Can't wait! :cheer2:

Just had some good news! Disney didn't exercise ROFR, so BVC is a new home for me once I get thru the closing! Woo hoo!!

I was impressed with the timeframe - it wasn't submitted to DVC until 2/27, so to have approval 15 days later is great!

I just love BCV. I held off staying there because I didn't think I would like it, but fell in love. :cloud9: Congrats on your new home resort!
