Jon Gosselin has struck back. After TLC removed his name from the title of the reality show, Jon & Kate Plus 8 Tuesday, the 32-year-old reality TV dad, via his attorney Mark J. Heller, sent the cable network a pair of letters stating all filming and production crews are heretofore banned from his family's Wernersville, Pennsylvania home.

"Effective immediately, no production crews are to enter Jon's family home for any reason. In the event that anyone enters the marital property, Jon Gosselin will notify the local authorities to effectuate police action against any trespassers," his lawyer Mark J. Heller wrote to TLC.

Jon states that both he and Kate both own the property where the show is being shot, that he has joint custody of the kids and that he is able to make decisions about their welfare. The story was first reported by The Insider.

The letters from Jon's attorney to TLC were dated Tuesday, the same day the network announced it was minimizing his role on the show and changing the name to Kate Plus 8.

Jon now says he believes it is not in the best interest of the children's welfare to continue with production of the show.

He also says he found out about the show's name change by reading about it in the press and that he has been in discussion for weeks with the network about pulling the plug on the show.The father-of-eight is currently in Los Angeles for a press tour which starts Thursday, when he will be a guest on Larry King Live.

Kate Plus 8 airs Mondays at 9/8c on TLC.

So, what was Kate doing in DC?

I know there are 3 major airports in the DC area, but the closest ones to Danbury are Hartford and NYC (that would likely have available flights from DC). So while insisting that the charity foot the bill was a horrible thing to do, driving to Danbury wasn't too unreasonable.

She could have taken a CJ into White Plains. A 20 min ride at best into Danbury. Even JFK & LGA could be less than 40 min. to Danbury timed correctly for traffic.

Oh man oh man! Kate is going to be furious. But Jon is totally within his rights to do that, they are his kids too. I do question his motives though. Seems like Kate and TLC wanted to play hardball and assumed Jon wouldn't do anything to retaliate. Wow. What is TLC thinking? Why atagonize Jon when he still shares custody of the kids and is just as able to make decisions for them? What a circus. I have a feeling that those poor kids are going to be dragged through all this in court. Hmmm, I'm wondering if Kate is really orchestrating behind closed doors and is demanding Jon be dropped from the show? It seems very likely IMO, we know how controlling she can be. I actually think stopping the show will be in the kids best interest right now so I wonder what will happen with Jon's latest filing.

Jon Gosselin is attempting to shut down production of TLC's Kate Plus 8 by denying permission to videotape his eight children, according to reports.

Through his attorney, Mark J. Heller, Jon, 32, has written two letters to TLC lawyers. In the letters andmdash;dated Sept. 29 andmdash; Gosselin demands the network cease and desist production and leave his property, according to The Insider.

According to Gosselin's lawyer, both Jon and Kate, 34 andmdash; who announced they were ending their 10-year marriage in June andmdash; own the $1.1 million Wernersville, Pa., estate where the show is filmed.

Jon has joint custody of the kids and is able to make decisions about their welfare, his lawyer says.

"Jon realized his family was like a trainwreck, so he decided to put the brakes on the divorce and on the show ... because if he didn't, the family would be in a mortal accident ... the victims of a trainwreck," his lawyer tells Entertainment Tonight.

His attorney also tells ET the original agreement between TLC and the Gosselin family "may very well be 'null and void' and unenforceable." But he claims that TLC never secured the special permits required by Pennsylvania Child Labor Law as a "prerequisite" for the Gosselin children's involvement in Jon and Kate Plus 8.

Heller also claims that TLC "failed to designate the appropriate compensation to be allocated to the children" and "it may ultimately be determined that TLC has not provided for compensation for the eight children over the past four years."

His lawyer further alleges that the network "never secured location permits" for the production company to film the show on the Gosselins' property.

His lawyer says that Jon found out about the show's name change the same way as everyone else andmdash;through The Associated Press. He adds that Jon had been in discussions to take the kids off the show for weeks prior to Tuesday's announcement.

I think it is very possible that TLC will continue filiming off property until this is settled. I doubt that TLC is going to fold up shop on Kate plus 8 just because Jon wants them to. Kate will demand that filming continue and Jon will be paid off.

Fasten your seatbelts, it's going to be a bumpy ride! I'm a little shocked! His motives are not pure or he would have helped get the kids off TV a LONG time ago, but this sure is an interesting turn. Oh how I wish it didn't involve 8 innocent children and their real lives, b/c it would be the best reality show EVER! (not what is filmed, but this side show)

This is all the new lawyer, but I'm not sure what the goal is? I don't really see this turning out well for any of them.

Yay...I'm sure it's not about the $$

Well, it can't be about the TLC pay cheque -- there's no backing down from this one...he's burnt that bridge for good and since his lawyers are involved ie. it's not Jon giving an interview at the fence, I have to believe that they already know what the outcome of this will be. I honestly believe he was telling the truth when he said he was trying to get the plug pulled for weeks. Jon has accidentally said he thought the show was bad for the kids on several occasions, but the gag order was still in place so he would have faced breach of contract charges had he not retracted those statements. IMO, I don't care why he did it because it is the right thing to do, at the very least for right now.

Having said that, this is a very interesting position for him to take in divorce court -- looks like the judge's decisions re custody arrangements will have to be based on what they think about the kids doing the show. JHMO, there is no way any marriage could survive a difference of opinion like this.

I don't know anything about PA law, but I can tell you that where I live only 1 parent would be required to consent for anything for their kids so long as they are married (either legally or common law) ie. it would be impossible for Jon to stop the filming of the kids until they were separated.

Makes me wonder just how long this has been going on ie. is this the reason Kate said she had to file for divorce, or the reason she decided to ask for full custody? Is this why she refused to delay the divorce? I'm thinking "yes" to all of these.

good point, I hadn't considered that.

I'm not sure what I think about the implications about the child labor laws. They shouldn't apply b/c the kids are not actors (which is the problem that needs fixing), but there was an investigation by the PA labor board so perhaps that plays into this as well. Absolutely those kids deserve compensation secured in their names. I hope they get it, but most of all I hope filming of the kids stops.

I think Jon realized his name was no longer going to be associated with the show which means less exposure for his name and less money in the long run. I also don't believe he has been thinking about this for weeks, this is a result of TLC's decision to take him off the show.

I actually think he has been trying to get out of his TLC contract for months, but I don't think he expected the show to go on without him. Too bad a member of the camera crew isn't on the DIS. It is my understanding that only one parent needs to agree to the filming while the parents are still married. Also, only one home owner needs to give permission for the film crew to be on site while they both own the home.

Jon is a tool of epic proportions.

Yes, it is extremely transparent and sad. I think Jon may soon regret opening this can of worms.
