Penalty phase...what will the jury decide? (1 day poll!)

  • Death

  • Life (judge will sentence within 60 days, LWOP or Parole in 25 years)

  • No unanimous decision...new penalty phase jury will be empaneled.

Yes. The jury decides if the criminal is given life or death. The judge decides the penalty only if the jury does not put the criminal to death. I've known it to be like this for all the states that still have the death penalty. I'll admit, this is the first time I've ever seen the aggravated portion of a trial though. I don't know if some states skip this portion and go straight to deliberations for sentencing.

Did a little more research.

There are actually 5 states the judge decides the sentence:
Montana
Nebraska (3 judge panel decides and must be unanimous for death).
Alabama (Jury makes recommendation).
Delaware (Jury makes recommendation).
Florida (Jury makes recommendation; majority-for-life-recommendation can only be overridden if no reasonable juror would vote for life).

There are 4 additional states with exceptions.

Indiana (Judge decides sentence only if the jury is not unanimous for life or death).
Missouri (Judge decides sentence only if the jury is not unanimous for life or death).
Ohio (3-judge panel decides sentence only if defendant pleads guilty; judge can override a death verdict in exceptional circumstances).
California (Judge can override a death verdict in exceptional circumstances).
 
That is all Jodi gave them to work with. She rambled to much and had nothing left to work with. I bet they give her death.
 
Mitigating circumstances:

1. 27 years old
2. No prior criminal history
3. She's a good friend
4. Lacked support from family
5. Abused and neglected as a child and an adult
6. Tried her best in life - (or something along those lines?)
7. Tried to improve herself
8. Talented artist

5. She suffered abuse/neglect as child/adult.

6. She tried to make the best of her life.

7. She consistently tried to improve herself.

8. She is a talented artist.
Hhmmm....

Whoopie Doopie Doo.... I don't give a crap! She murdered Travis!
 
Personally, I don't think that she's medicated at all. I don't even know that reality has set in. I think that she's still playing a roll and trying to gain sympathy.
 
I've lurked here a long time . I thank you for great updates and commentary. I homeschool so I really haven't been able to watch day to day proceedings. I have to say that you were all the first people I thought of when the verdict came in. Well, the kids are getting some well earned screen time today so I can watch this phase.

Is it normal that JA's mom doesn't cry? I would like to think that if it had been me as the defendant my mom would have been crying much more as she felt totally out of control in trying to help her daughter

Nurmi just confirmed that #JodiArias will take the stand at some point in this penalty phase.
 
Thought impact statements were first? How long will opening arguments be? I'm watching on HLN (help me!!!!) and right away we have a sidebar. Ugh
 
Some reporter just tweeted that Nurmi is losing the jurors on all the legal talk....

She also tweeted that she's wondering, based on what Nurmi is saying that JA may speak in this phase!
