My dad ending up passing away just before midnight last night. I spent the day at the Church and Funeral home making plans. Tonight we were at a mass for my daughter's friend who is still in critical condition.

I feel like I'm coming off a weekend bender after the long trial testimony yesterday. So much of it was boring and made me tired! It's good that closing arguments are today, and soon we will have a verdict.

And I didn't get the 2nd question because this was posting. We need you BearcatsFan!

That mistake Dr Horn made about the perforation in the brain membrane (or lack thereof) is not good.

I was a little bummed with the typo error, but in the end that is all it is, a typo. It doesn't invalidate his entire report like JW was trying to say. I believe the jury gets it.

I hate to say it, but I did chuckle at the question from the jury to Dr. Horn:

Q: Would you believe that 100% of the people with frontal lobe trauma are deceased when you see them?

Dr Horn: I hope so.

Well, he is an ME so he doens't see people who are alive in his job.

I feel bad for JM ... It's getting late and he gives his closing arguments tomorrow first ... I hope he gets a chance to get some sleep tonight ...

JM will be just fine. This isn't his first rodeo, and he'll be on his game. It will be interesting to have him connect all of the evidence for the jury.

And the jurors too have to drive home (I wonder how far they live?) and be there again tomorrow.

When I brought my Mayce home almost 13 years ago, she was wearing a little carters yellow fleece bag thingy. When my kiddo was born, everybody said she looked like a porcelin doll, she was so perfectly white and precious with a tiny painted red mouth. Anyway, we stopped at my parents house first and after I unbundled her from the carseat, my dad picked her up and said "She looks like a twinkie!" hahah, the yellow with her little white head poking out did make her look like a twinkie, and that is a nickname my kid still carries!

1. Would you agree that 100% of the people you see with frontal lobe trauma are deceased at the time of your examination?

2. Your report stated there was no damage to the dura mater membrane. Can you explain how the brain can be damaged without damaging the membrane.

When exactly did the jury HEAR that testimony about there being no puncture of the membrane? Or did the jury SEE the report? Because if there's an error IN the report, that's one thing. But if he ALSO testified to that fact, that's another thing...not good.

During Dr. Geffner's direct testimony, when Willie was aking him about the frontal lobe and brain, etc. he or she brought up that the membrane was not punctured (which was stated in the ME report that Dr. G kept saying he was basing his entire opinion on because he assumed it was accurate, valid, blah blah blah ) ... Then it wasn't until the last juror question that asked about the membrane being damaged that it was brought up again ... At that point, Dr. Horn looked at his autopsy report and said that it had to have been punctured/damaged and it was just a typo in his report that said otherwise ... Of course, Willie pounced on the typo on re-cross and started saying things like "you do know this is a capital case" blah blah ... And then tried to discredit him and the accuracy of the report, etc. ... Dr. Horn stuck to his guns and kept saying it was a typo and that there was no way the membrane wasn't punctured/damaged ...

I don't remember if this membrane was ever brought up in Dr. Horn's previous testimony or this was the first time we heard about it though ... I think Willie and Dr G purposely set it all up yesterday and I'm kinda thinking that Dr. Horn was ready for it and was prepared to say it was just a typo ... I don't know how this will affect how the jury feels about the autopsy report and Dr. Horn, however ... I'm hoping it's no big deal to them ... But I guess it all depends on how much they weigh in the TA being shot first or last theory into their deliberations and ultimate verdict though ... Ugh ... It's so important that JM really focuses and brings home all the evidence pointing to premeditation in his closing today, otherwise, I don't know what's going to happen ...

My brain is tired, but I think my hippocampus is working fine. So here's what I remember:

Dr. Geffner testified that he used Dr. Horn's reports to form his opinion that the brain was net affected by the gun shot, that the gun shot missed the dura membrane. All of that was based upon the typo in the report. AFAIK, Dr. Horn never testified to this. He said based upon the trajectory of the bullet, it pierced Travis' brain and would have immediately incompacitated Travis if the shot had happened before the stab wounds, and we know that Dr. Horn testified that the stab wounds occured first. So the jury question was because Dr. Geffner stated that there was no puncture to the dura membrane, and that was in contradiction to prior testimony by Dr. Horn.

Based upon the surprised look on Dr. Horn's face last night, it was a typo. He said it had to have gone through the brain. I'm dissapointed that the type wasn't caught in the first place, but in the end Arias' account is a lie, and she been proven to be a liar. I believe the jury will discount her statements completely. Samuels and ALV were discredited before the experts for the prosecution even took the stand, so I'm not worried about that either. My only concern is that will this typo error cause jurors to question the entire report. When they go back to deliberate, I hope they take a good look at the autopsy photos, those pictures really drive home the brutal and cruel murder of Travis.

That's why the State keeps saying Travis was shot last despite the fact that Travis actually could have been shot first and still been alive and this would still apply under the second bolding above.

At least that's my interpretation of it.

I guess I see it this way, the entire DT's strategy has all been based on lies, every single one of them lied and tried to sway reality. Every one of the state's witnesses has been quite credible without going back and forth and making things up. While it does suck that there was a typo, I'm inclined to believe that the jury will be smart enough to look at all the evidence and realize it was nothing more than a mistake. I have faith in this jury...I think. Too bad Juror #8 couldn't leave his notes with everybody.

Willie asked Dr. Horn at the end of his testimony if he was sure his report was correct and if was absolutely sure about it. She didnt bring up the mistake b/c I think she would have saved it for closing or for a reason to appeal. Im glad the juror asked the question and he cleared up that it was a mistake and was honest about it.

Ive had a little experience with medical software and they now have some automated answers to typical scenarios that are common and am wondering if that part of the report was automatically generated and not manually typed out.

Still a little confused about why it all just came out last night tho. For all the whining and pouncing Willie did when she questioned Dr Horn last night after the jury question, about does he realize this is a death penalty case, yada yada yada, why did NO ONE else catch this before? It doesn't seem like Willie/Nurmi did, because had the juror not asked this question, Willie would not have gone at Dr Horn. Unless it did come out more when questioning Geffner. I don't know...I half snoozed through his testimony and only perked up for burping, spilled water, and his laughing. crazy: )

This evidence has been around, and supposedly scrutinized by both sides for YEARS.

Great info ... I just wish that this autopsy "typo" wasn't brought into the forefront whatsoever yesterday ... However, I don't remember if it is actually old news or new news? ... But either way, it's fresh in the jurors minds now ... Not that Willie or Nurmi wouldn't have brought it up in their closing regardless ... But how the heck wasn't the "typo" caught prior to Dr. Horn testifying? - thats what I'd like to know ... I would hate to think that a "typo" could ultimately affect the entire outcome of the case now, ugh ... But who knows, maybe all of Dr. G's testimony yesterday changed the perspective for some ... I think it all comes down to closing arguments ... All I know is, I could never be a trial lawyer - it's just too stressful and I would probably always be held in contempt anyway because I wouldn't be able to hold my tounge in the courtroom or I would just end up punching someone ...

Here's what Beth Karas is saying about today, tomorrow, and deliberations (will link in First Post):

When court resumes today, Judge Stephens is first expected to instruct the jury on the law. That could take 30 - 45 minutes but probably not much more than that. After that, the jury will hear the first of 3 closing arguments. Juan Martinez will speak first and he could take the bulk of the day today. He may use some of the hundreds of exhibits which were introduced into evidence...photographs, diagrams...to help him illustrate his closing argument.

Once Martinez finishes later today, perhaps, the defense will go. Jennifer Willmott gave the opening statement for the defense, so we believe that Kirk Nurmi will give the closing argument. So Nurmi could begin later today. If not, he'll give his closing tomorrow. He could talk most of the day tomorrow, and whenever he wraps up, Juan Martinez will give the final closing argument...it's a rebuttal. Much shorter...maybe AN HOUR OR TWO. Then the jury will get the case. So this is going to take all of today and tomorrow.

If there's enough time tomorrow, jurors might actually start their deliberation, and before they do, the three alternates will be selected. Whoever those alternates are, they will not be EXCUSED while the jury deliberates and that's because if the twelve jurors deciding this case come back with a verdict of FIRST DEGREE MURDER, those alternates need to come back because there will be more to do. There will be more phases in the case...an aggravating phase, and a penalty phase.

That's what we can expect in the next few days...all closing arguments, perhaps a verdict next week.

He could talk most of the day tomorrow, and whenever he wraps up, Juan Martinez will give the final closing argument...it's a rebuttal. Much shorter...maybe AN HOUR OR TWO. Then the jury will get the case. So this is going to take all of today and tomorrow.

If there's enough time tomorrow, jurors might actually start their deliberation, and before they do, the three alternates will be selected. Whoever those alternates are, they will not be EXCUSED while the jury deliberates and that's because if the twelve jurors deciding this case come back with a verdict of FIRST DEGREE MURDER, those alternates need to come back because there will be more to do. There will be more phases in the case...an aggravating phase, and a penalty phase.

That's what we can expect in the next few days...all closing arguments, perhaps a verdict next week.

Thanks for the latest schedule, I'm really interested in the jury instructions. I sure hope they can see their way clear to coming back with a first degree conviction.
