Expert misconduct (or just being plain idiots) outside of the courtroom and the jury's presence is not typically grounds for appeal. Even if her testimony is tossed which is extremely unlikely. Ineffectiveness of counsel is another matter entirely. Appeals examine the trial record, not the surveillance cameras from the Boy-Howdy saloon down the street.
 
I was thinking it would be a mistrial, since ALV is the DT's only DV witness (which is the cornerstone of the defense) ... there wouldn't be enough time for them to prep another DV witness, and that would lead to a mistrial since the DT couldn't adequately present the defense without a DV expert.

Or am I thinking completely wrong? :confused:

I wouldn't think a mistrial would be ruled because it's the DT's own choice to have only one DV witness ... They could have round up as many as they wanted and tortured us with years of BS testimony ;) ... I just suspect that Violet was the only one that agreed to testify on JA's behalf because all the other DV experts know that JA is full of you-know-what ... But I could be wrong also ... :)

Over on WS, the number asked ranges anywhere from 6-11. There has also been talk of ALV being the Mitigation Specialist in the beginning but since nobody would testify as the DV expert, she changed roles. Not sure how much of it is true.

Very interesting ... I think JA maybe wishing she had come up with a fourth story instead of going with her third lie of self defense ... I think she would have had a better chance with going with a temporary insanity defense or she killed TA in a heat of passion rage because he was cheating on her, wanted to break up, etc. ... Then maybe she would have gotten away with 2nd degree murder charges ... But who knows :confused3 ... She maybe thinking that her experts & witnesses are doing a stellar job for her ... And maybe they are in the minds of the jurors too :scared: ... Like we've all been saying, nothing matters but what the jurors think :confused: ... Time will tell ... :)
 

I believe AL said she has been taught the ins and outs of court for testifying , I am sure she is aware of the law for victims rights. I can not for one minute believe the judge is that stupid to believe that the DT did not know.

But I do believe Juan will take care of it.
 
I've scanned the thread and haven't found out (even tried googling), but does anybody know why ALV spoke to TA's sister (what was said)? It's obviously a totally inappropriate thing to do. If I understand correctly, ALV actually went to the sister - not an accidental confrontation. Seems a little bizarre to me.
 
I wonder if Dr. Samuels will be diagnosing ALV with PTSD soon?

I want to say a couple of hours. I thought this might have been the time span of when she went to get her "nails done" in Salinas. Darryl would have known she left with blonde hair and returned with brown. I think JM was hinting around ,making them think it is about the remote when in fact it is about the nail/hair/waxing salon. I do think the remote was exchanged at sometime but not sure why. I still think she blackmailed Darryl and that is why he seems to speak positively about her. I bet she blackmailed him with something, maybe pedo claims. Since he has custody of his son, he would probably go along with her.

Well, at best then her drive time maybe 45 minutes. I will give her the extra 15 minutes. Its a two lane highway, coming and going til you hit the freeway and depending what part of Pacific Grove he lived. I can't say exactly what exit . At the worst it would be about 3 exits to the other side of 68 to PG.
 
Okay.... my friends, have to tell you this funny thing happened this morning.
I went to my nephew's little league game...where the coach pitches to the kids and they are so little and so sweet (he's 6).

He has some issues, he will get distracted by a fly or a plane while out on the field. When he puts his hands on his knees, he starts looking for bugs on the grass. That's our Johnny.

So I drive 2 hours to come see him play today. He was sooo excited Auntie was there.

One inning, he was playing 3rd base. I go to the fence to cheer him on "pay attention" "watch the ball". He was so cute and listening to Auntie.

A batter hit the ball to right field and he was starting to run towards second base.

I yelled "Johnny, cover your base!" He stopped dead in his tracks and covered his face with his glove and other hand! :rotfl2:

Me: "Not your face, your base!" LOL and he went running back to 3rd base.

I kept the kids home from school today. The one who was feeling better started throwing up again last night. Ugh. On a positive note, I am not at work so I won't miss any of the trial today.

How cute is that?!?!

I told my Grandson one day while we were playing catch,he was about 21/2 to keep his eye on the ball. He looked at me picked the ball and put it on his eye.

It was so funny.. I laughed so hard and he just looked at me, like thats what you said grandma. :rotfl2:
