Intersting POS language

I probably have the most recent POS, which we received just two weeks ago as part of our SSR Add-On purchase.

It's dated 7/25/2006

Here's the complete, entire section about transfers:

"Transferring Home Resort Vacation Points Bwtween Club Members. Transfers allow a Club Member to assign all or a portion of his or her Home Resort Vacation Points to another Club Member. Transfers are subject to the following restrictions:

1) Both Club Members must be current on their Annual Dues and monthly payments (if applicable), and any other outstanding balances, including, but not limited to, fees associated with any exchange programs, miscellaneous services booked by Members Services in connection with Club Member reservations, and any incidental charges and/or balances due in relation to DVC Resort stays, in order to give or receive a Transfer. Both Club Members must be closed in order to participate in a Transfer.

2) All Transferred Home Resort Vacation Points retain the Use Year of the transferring Club Member and expire at the end of the transferring Club Member's Use Year, unless they are Banked.

3) Once Banked, Transferred Home Resort Vacation Points will expire at the end of the Transferring Club Member's next Use Year, unless they are used. In addition, Transferred Home Resort Vacation Points cannot be un-Banked or returned to their original Use Year.

4)The Club Member who is Transferring the Home Resort Vacation Points to another Club Member is still resonsible for the Annual Dues payment on those Transferred Home Resort Vacation Points.

5) Banked or Borrowed Home Resort Vacation Points may not be Transferred.

6) Transferred Home Resort Vacation Points may not be Borrowed or returned to the Transferring Club Member.

7) If a Transfer occurs between Club Members from different Home Resorts, the Transferred Home Resort Vacation Points retain all the reservation rights of the Transferring Member.

- The recipient of the transferred Home Resort Vacation Points may use them to make a reservation at the Transferring Member's Home Resort during the Home Resort Priority Period, or at other qualified DVC Resorts after the Home Resort Priority Period and any other applicable priority periods.

- The recipient of the Transferred Home Resort Vacation Points would not be able to use the Transferred Home Resort Vacation Points at his or her Home Resort until the end of his or her Home Resort Priority Period and any other applicable priority periods.

8) Transfer requests may be made by phone and must be confirmed in writing, by mail, fax or E-mail, to Member Services. DVCMC will not assist Members in finding another party for a Transfer activity.

9) Club Members are expressly prohibited from receiving compensation for engaging in any Transfer activity.

10) During a given Use Year, only one (1) Transfer per Club Member or Club membership, either as Transferee or Transferor, will be permitted.

11) Only Club Members who have closed on their purchase agreement are eligible to transfer Home Resort Vacation Points."

Two things I noticed are that transferred points cannot be borrowed, and that a transfer request made by phone must be followed up with written confirmation.

Also, it appears item #11 is redundant to the last sentence in item #1

And from both my personal experience and per several PMs sent, select MS-Advisors are now strictly following the Per Member as previously challenged by WMD on another thread that I posted on.

So, you are "personally confirming" that a member with multiple contracts cannot transfer points from one of his own contracts into another in order to make a reservation? .. or this one of those posts that no one should believe?

Yesterday, I was incorrectly told by a manager that transfers between a single owners Memberships were unlimited. He also could not tell me if next UY, I would be able to transfer to myself one time. He also is not aware of the combining points for the smae resort from different memberships for ressies at the 7 month mark. I would love to do this as I am stuck with 9 banked BWV points in one Membership (Oct UY), none left to borrow from in 07, and many available BWV points in another Membership. I am going to request this 'combo' via email, with a copy of Doc's POS and see what happens.

Clearly, changes are in the air, and individual results are varying depending on what Advisor you get (Sound Familiar?)

For completeness' sake, here is my original post that WebMasterDoc questioned:

Here is a clarification.

I can personally confirm, that the one transfer per use year is per Member, not per membership. One transfer per person, per year. Not per membership/master contract.

Please let us know what happens. Actually if you can combine the points for ressies at the 7 month mark that is kind of like unlimited transfers between your own contracts at that point - just a little different wording. Certainly would be nice.

DVC has always allowed more flexibility between multiple contracts of a single owner even allowing multiple transfers when the rules only allowed one and allowing banked and borrowed points to be transferred. It remains to be seen how this situation will be handled currently.

It's pretty easy to add emphasis to support the point you wish to make - just as I have done above. Incorrect statements should be challenged - whether it's here on the DIS or when dealing with MS.

I just got off the phone with a very knowledgeable, helpful CM at MS. I asked about transfers for members with multiple memberships and she even verified the policy with her manager before responding. She then quoted the POS and the fact that transfers are limited to one per Use Year (either in or out) per MEMBERSHIP. Members with more than one membership may transfer points from one into another without problem as long as no other transfers have already occurred for that membership during the Use Year. If you own four MEMBERSHIPS (each with a distinct MEMBERSHIP number), you would be allowed four transfers (either into or out of) per Use Year. If you own a contract with multiple add-ons, you would be allowed only one transfer since those contracts are included under a single MEMBERSHIP.

While there may be some CMs at MS who would disallow such a transfer, I know of least one who will complete a transfer based on the restrictions noted.

Thanks, Karen! :)

That is c/w both my info and experience. To point out the obvious, if you transfer from one to another than takes up the one options for both of those contracts. As I noted above DVC has been more flexible for multiple contracts of a single owner on a case by case basis. It remains to be seen whether this will be any different in the current climate.

Before I attempted my transfer, I checked with a MS Advisor (at the end of another call), ans she said there would be no problem transferring into/out of my #1 membership, as it has never had a transfer.

But when I attempted it (the transfer) now 3 seperate MD Advisors have disallowed it (2 didn't know why and had to research) for a transfer in my # 3 account.

Anyone can say anything about something they haven't attempted or completed. What I am reporting here is not a casual conversation, but the actual results of attempting a transfer 3 seperate times.

I will share your converstion with Karen when I speak with compliance, hopefully it will help.

Why check with 3 medical advisors (MD Advisors) regarding DVC transfers? :smooth:

As for saying "anything about something they haven't attempted", I did attempt to transfer points from one contract to another and was told I could do that - but I opted to bank them instead.

What I am reporting here is not a casual conversation, but the actual results of attempting a transfer between my accounts and having MS confirm that it can be done and providing the legal support language this CM would use to allow the transfer.

If you were trying to transfer 3 "seperate" times, maybe that's the problem - transfers are allowed only once per Use Year.

Another difference may be that I have never transferred points before in any of my accounts and I have never rented any points before. Perhaps your past record of transfers and rentals has something to do with your inability to transfer at this time. (?)

All I was sharing was my personal experience with MS. YMMV.

Tony, non one doubts your experience but if I recall you had only 1 transfer for your ?4 accounts and it was in a previous use year, that makes no sense. Plus it's different than some of our experiences and not c/w past experience as well. As I stated earlier, there may be something else going on here or it just may be the adjustment MS is having to this version of the rules. But as I noted previously, I would be concerned something else is going on with your contracts. Did they combine points form multiple contracts for a single night stay or some similar issue that they might not describe as a transfer but indeed is still technically such on DVC's end? Don't you rent out at times, any chance a guest had charges they didn't pay like phone calls? Let us know what you find out please.
