I want to make something, and see if it sells...what do you think?

I want to by unfinished children stools, and paint them into Disney stools. Mickey, Goofy, Pluto Ect for the boys, and Princesses and the likes for girls. I will do one and post a picture.

I went to look around in AC Moore yesterday, and just trying to pick out paint colors, shut me down. It is a real effort for me to be crafty! :teeth:
 
I could be completely wrong, but I think you might have to get approval from Disney before you make any money off of their characters. Otherwise, it sounds like a great idea.
 
Disney will shut you down in a heartbeat. All the characters are licensed, and cannot be reproduced for commercial use.

Disney is very strict about this policy, and has sued plenty of people. It is not worth the risk.
 

Wow, you should go to the Flea Markets around this area and look at all the stuff that Disney could sue for. When I lived in Germany, I bought several pieces of handpainted children's furniture from a little shop in downtown Wurzburg.

That's what I mean. A few stools on Ebay. The store sell the Disney rub on's. So, I can make my own stool for my own kids. I can't sell it at yard sale in a few years?

I am not talking about opening a store. I want to make a few stools, and pocket some extra money for Christmas.

But, I will contact Disney (somehow) and find out how I can get a license to sell their characters.

If I hire an artist to come in and paint a Disney scene on my kid's bedroom wall, and I pay the artist, are they infringing Disney Copyright?

Yes, they're infringing on Disney's copyright.

You can make your own crafts with Disney characters for your own private use without any problems. You cannot make a proffit from Disney's characters. You can't even go to the store and buy Disney rub-on transfers, make a craft with them, and then sell those. You'll notice that anything with Disney characters on it (whether it's a rub-on, stencil, fabric, or whatever) will have a statement saying that it's for private use only.
 
Why don't you use the same idea, but paint what the buyer requests (something that would not violate copy right laws). When my kids were young, I couldn't get enough stuff with their names painted on with flowers or trucks, sports equipment, etc.
 
You won't get permission from Disney. Disney is very strict about the uses for their images. You don't want to see what fines you can incur for using their images.

Yes. You cannot reproduce any copyrighted characters. If you buy
a Disney character door from Home Depot , an authorized dealer with a licensing agreement w/Disney, and put that in your childs room, fine. If you go to habitat for humanity resale , buy a plain door and hand an artist a picture of Disney's Cinderella and say, "paint this please and I will pay you $200.00" The artist is braking the copyright laws. We do hand-painted children's furniture and I cannot count the number of times we have been asked for a 'Disney Princess Bed'. We can't legally do it. Many artisans and craftspeople skirt around the cr laws by making small changes in the design.
A 'Bob the Builder ' bed becomes a 'Ben the construction guy' bed with some changes in colors and design. I'm not sure how that flies legally, but ethically
it is something we won't do. Now if you are painting it for your own use and not getting paid for it, I suspect that is a different thing.

I remember someone posted on this topic a few months ago and they had a Disney mural in their Preschool classroom, and "someone" from Disney saw it from an outside window and contacted the school and they had to paint over the mural.

Here's a what if for those of us on this thread:

What if an artist provides the child's stool for the OP and charges for that but throws in the painting for free. Is that copyright infringement?

Oh good point! I am paying for the stool, not the painting.
 
Just so you know, when Disney sues (and it's very possible they would) they can go for damges which would be much more than the profit you made.

You can make things from the licensed material retailers can sell. You can not however make something with those materials and sell it. You would need to get your own license from Disney to do that.

If you used an officially licensed product like rub-on transfers and apply it to your stool, decorate it, and sell it on ebay it's like what tabberone is doing to the fabric.

She also places a disclaimer in her auctions: This is not a licensed Disney item. It is however, hand-crafted with care from licensed Disney fabrics. Tabberone is not affiliated with or sponsored by Disney.

Keep in mind, though, many companies have went after her. :badpc:
