What it boils down to, Epcot Beauty, is how much of a battle you want to get in to with this guy.
Realistically, he is being discriminatory. I'm no lawyer (nor do I play one on TV
) but I would imagine that somewhere along the line, what he is doing and "implying" is against labor laws.
But, the bigger question is how much aggravation do you want? Do you want to call him out and go the distance to prove he is discriminatory? Or, is this The Universe telling you it's time for a change and this is giving you the catalyst to do so?
I had a job years back in an insurance company. Nice job, nice people. Then they hired a new boss and I became the victim of reverse discrimination. I hung for as long as necessary to become 100% vested in my retirement. Could I have probably won if I sued? I think so. I had stuff written by her that was so blatantly disciminatory that it was lamost laughable that someone in a management position could be so stupid as to write that stuff down. But ultimately I decided it wasn't worth my time, and more importantly, my energy.
The day of my exit interview, I copied my packet of documentation, laid it on the desk of the HR person who was doing the exit interview and said "Because it's not worth my time or energy, I'm not suing the company or this woman for discrimination. But I thought you'd be interested to know the caliber of employee she is".
Coincidentally, a week later I heard that she was demoted from being a department manager to being on the "special projects team" and shortly thereafter, her new position was eliminated. Karma baby!
So think long and hard about what you desire to do.

never heard of it unless it has urgent care component. Doesn't happen.
I am sure you number 1 priority now is to get the heck out of there.
