Oh he knew.....I just didn't want to say anything as I felt it would be better DH talked with him. Just didn't realize poor DH wouldn't get much said as the guy went on and on. Probably wouldn't have been any different if we just had it on speaker phone. :confused3

Sometimes you have to pick your battles. At this point I'd consider it done and over just to get this whole thing finished.

Yes you could go after the other guy but since it seems it would cost about $300 to get the tree replaced I wouldn't bother. I don't think it would be worth my time and aggravation. But I would be posting on a FACEBOOK page, YELP, and Angie's list if the bad company has listings there.

I so agree with the bolded. I really don't want the hassle however the way this guy started turning things around and especially the part of now he wouldn't call the job done a freebie.......I just feel at this point; fine don't replace the tree BUT don't charge us either for your mistake. I think that's the only way we would go farther with this.

Meanwhile DH and I decided we would just go with Company (B) for the rest of the trees.

I really feel we don't owe Company A the rest of the job.

Maybe the OP should alert the local newspaper and news stations as to her experience with this "business."
 
The guy destroyed a tree that is going to cost several hundred dollars to replace. Why do you seem so willing to let him away with that? He came without a contract and without your permission. He destroyed your property and his answer is "I won't charge you for it". That's mighty generous of him not to charge you for the damage he did while trespassing on your property. :rolleyes:
 
It may not be small claims. The cost of replacing a 10 yr old baby oak may be beyond the scope of monetary limits of small claims. I would be getting estimates from certified arborist on its value.

Also I would file a trespass warrant with my local PD and have them served. A precaution that puts them on notice to steer clear of your property.

I was wondering the same thing.

For the owner to be so bold, it does kind of seem like he might have done it before. He was probably successful at it more often than not too. Probably brushes it off as a miscommunication and waits for the resolution to be in his favor while the homeowner is surprised and dismayed at an awkward situation. Wouldn't be surprised if it has worked for him in the past. People want to get this kind of thing over with and be done no matter if the other person is at fault. (But I wouldn't pay for it, when clearly he did not have an agreement.)

I think you need to write reviews on every website you can find so this guy doesn't do something like this to other people. Obviously, he doesn't feel bad for something he screwed up. People who are thinking of hiring him should know about how shady he is.


He has a website but no place to do a review. Darn! I would love to know what websites are out there that we could give our honest review of this shady dude.

I know that Yahoo has reviews on their website for businesses. Maybe put in Yahoo business reviews and see if you get a hit.

I'd leave online reviews everywhere possible. Lots of them. Make sure other people know how they operate. I'd also send the certified letter. Hey are getting off Scott free. They messed up hey don't get to charge you for that. They should replace the tree they ruined. But make sure you leave honest detailed online reviews to warn people.
 
This man didn't bully your husband into agreeing that he owes them for the unauthorized work and taking down of a tree that you wanted to keep, did he? I wouldn't be giving that man a dime.
 
I dont understand why you are letting them off the hook so easily?

We have a different company coming out today to take the other trees down. Even tho I still miss my oak, I figured it just wasn't worth fighting this guy. He's not going to charge us for their service...good thing and we just called it even.

We have great pics of the baby oak in the background of pictures we took of our sons growing up so like their childhoods, the tree is just a nice memory!!:sad:

Ok enough of the sap!!! (pun intended ;) )

Something to consider ... when I was a kid and we moved from one house to the next, we left behind the tree in the back yard that we'd planted when we moved in. Obviously, we couldn't take the tree with us, but we had all those photos of us with the tree, etc. ... just like you. So it was sad to leave that part behind.

We ended up going to our favorite local park and "adopting" a tree there. We took a photo of us kids holding a photo of our old tree (corny, I know ... it was the 70s ...) and made that the official old-tree-to-new-tree "transfer" photo. And then, every year, we took a photo of us all under our adopted tree. We haven't updated that photo in years, as none of us live near that park any more, but the park is still there, as is our adopted tree (we can even find it on GoogleEarth!).
