HELP! What is the policy for canceling membership

Well we made the decision to buy into DVC while we stayed at Sartoga Springs back on 11/16. We have been on the fence for a while and if we were ever going to buy in the current incentive made it a very attractive offer. We toured the resort and after a conversation with our guide decided to go thru with the paper work knowing that we could cancel upon our return home. Our Docs state that we have 15 days after signing to inform DVC of our intentions via mail or Fax, has anyone ever done this? Our 15 days is up tomorrow 12/2 and I hate to say it but I believe we will be faxing our request to cancel in the morning, should I send it in the mail as well? I also read that the 15 days can be triggered by the last day that you receive your final docs, any help here would be very much appreciated.

Sorry to hear you have had a change of heart, but I would cover all possible avenues of communication in this situation. I'd call MS in the morning to inform them of your decision, fax your intent to cancel ...AND ... send by certified mail (return receipt requested) your written instruction to cancel. They may not require all three, but I'd still take that approach since you are waiting until the last day to use your right-of-rescision.

I believe Florida law says ten days from YOUR signature to rescind, but Disney gives you 15 just to be on the safe side. To rescind a contract is your legal right, not some special request, so you shouldn't feel awkward about doing it.

I'd follow Doc's excellent advice on the process just to be sure all bases are covered.
 
We did it the last possible moment by fax and it worked fine. No questions asked, deposit refunded. We later bought through a resale.

Should be no problem canceling, however, I have a question. Why did you sign up, "knowing you would cancel when you got home"? Honestly, being a sales person (not timeshares) that's a little annoying and, quite frankly, insulting to the sales person. If you had no intention of going through with it you should have politely told the sales person this and NOT signed up.

Sorry you are canceling but, in the future, you really should be more considerate.
 
Oops, sorry, re-read your post. You said, you, "could," cancel, not, "would," cancel. Sorry about that. :confused3

Wow! As a sales person, you should know then the salepeople who never take 'no' for an answer (not that this applied to DVC). It is also part of the sales pitch knowing that most people probably will not cancel. People change their minds after reviewing their situations and may have decided that it wasn't in their best interest. If they decided to cancel, it was the best thing for them and not the salesperson. I'm really surprised to read a comment like this as it is insulting, whether intended or not.

I'm sorry that you feel that way, the guide that we were dealing with knew our situation and on more than one occassion mentioned to us that we had time to think about it and if we decided to back out that was our right. I won't go into some of the factors that we had to weigh because that's our business, my question was answered and I really appreciate the helpful information that I received.

I am a real estate agent in NC. I worked onsite at a Condo for a while. NC has back out laws for condos too. I never took it personal or was upset when someone backed out. Even after doing alot of paper work and meeting after hours to get the contracts signed. That is your right to cancel within the time frame. Do not feel guilty. DVC will sell out and so did my Condos. Those agents will get paid.
 
If you all will read the post right after GadgetRick's and posted one minute after the first one, you will see that he admits to misreading the original post and apologizes for his comments.
 
I think for almost every situation, a salesman would prefer that you do sign on the dotted line, rather than walk out, even if you absolutely "know" you're going to cancel. Many timeshares use the right to rescind as a bullying tactic when buyers start to balk, knowing that a small percentage of those who "know" they are going to rescind actually do when they get home. (Do you know that of the "rebates" offered on consumer electronics and stuff, only a very small percentage are ever actually sent in?) DVC is lower pressure, but even if the recission rate is 90 percent, I would think no salesman would think even a 10 percent chance of holding onto the sale is a waste of time.
 
We rescinded on our first purchase due to my nerves. Because it was accepted so nicely 2yrs later I called the same guide and bought for good through him. He was just as nice the 2nd time and said it happens all the time.

I liked that story. Says a lot about both parties. Where did you buy? Enjoying your purchase?

Actually it's rather rude to insult the OP without even bothering to read the thread. If you had, you would have known that he was misquoted.
 
A reminder...

The purpose of this thread is to answer a question about the cancellation policy, not whether a person should or should not excercise their right to do so.

Yes we are enjoying it! The line about wishing we bought earlier is a bit ironic for us but true. It worked out for the best. If we had stuck w/ the first contract and anything unusual had happened I may not be enjoying my purchase. Waiting until we (mostly me) were sure makes it sweeter!
