Has anyone been able to collect unemployment after leaving their job?

I had resigned and I got approved by the state to collect unemployment. Now, almost 2 months later, I receive a letter that my former employer is appealing it.

Has anyone been able to collect after leaving their job? I'm just so annoyed that they approved it and now it could be taken away...

I went through this at the beginning of the year. I had worked with a horrible employer late last year and he forced me to resign. I filed unemployment and we had to have a hearing, the employer contested it. I was approved for unemployment b/c the state said that unless the employer could prove that I had deliberately sabatoged the job, they couldn't deny me benefits. He actually appealed that but never showed for the second hearing.

Funny this question just came up. I am in this postion right now were they are trying to get me to resign. All sorts of false accusations are being made about me and administration won't let me defend myself. Won't listen. All I hear is no excuse.

Have a special discinplinary meeting tomorrow at 1:00. not sure what to expect. There is a part of me that says tell them to put the job were the sun doesn't shine, but the problem is I love my job. I really like the students and the other aides in my class room. (besides other co workers out of my class room)

Have the union to back me up but yet I still wonder if I will be happy if I get to keep my job. Leaves me with a bad taste in my mouth. Still looking for a new position.

Why did you resign?

There are a few reasons...it was a sales position and I wasn't comfortable selling the product anymore...ethical issues...the only position they offered me was horrible...on the phone all day, staring at the computer, something I was overqualified for and less pay...I had gotten very sick in May and used up most of my PTO days, then had to have surgery and used more PTO days and took disablility for 2 weeks...after switching positions and doing a job that caused me to be constantly staring at the computer, it led to a severe migraine that lasted almost 3 weeks...I've had a history of them, but never that bad. After I came back from using all of my PTO days, my manager basically said that I can't take off any more work for the rest of the year. How could I know if I was never going to get sick again?? I felt almost pressured to leave. I have a telephone interview this Wednesday...hopefully it will go in my favor.

A friend of mine was successful, she had a verbally abusive woman as a boss. My friend started a diary of incidents and who was there when it occurred. She gave details to HR on her way out. The company initially fought it, but when the hearing came up, the company sent no one to state their side.

Many years ago I worked as an unemployment claims taker. For our state unemployment to pay, an employee who resigned had to prove it wasn't a voluntary resignation and that it was a valid work-connected reason. As I still work for the state workforce office, I cannot coach or otherwise lead a claimant in how they respond to an appeal. Be factual, try not to be too emotional in the hearing.

When we moved from CA. to MI. my DH tried to file for unemployment to help us out while he was job hunting, but they said because he quit just to move we wouldn't get it. It's a hassle. And your former employer can contest it.

Not to sound insensitive to your situation, but why not look for another job before quitting.

Going thru the hassle of unemployment and possibly having no income, I would have tried to find something else before quitting.

Of course I would have done that...but how could I have interviewed if I wasn't allowed to take any other time off from work????

It is very difficult to collect unemployment insurance after quitting a job, unless:

They forced you to quit (resign or be fired)
You can prove "constructive discharge" (They made life so difficult you had to quit due to mental or physical health) This is hard to prove

Unemployment is for people who were fired or were laid off. (If you were fired for gross misconduct it is hard to collect unemployement)
